STATE OF LOCAL EMERGENCY JANUARY WINTER WEATHER EVENT

RESOLUTION 25-01-21

A RESOLUTION OF THE TOWN OF JAY, FLORIDA DECLARING A STATE OF LOCAL EMERGENCY DUE TO JANUARY WINTER WEATHER EVENT

WHEREAS, the weather system identified by the National Weather Service poses a serious threat to the residents and property of the Town of Jay, Florida, and to the Town­ owned property of Jay Utilities; and

WHEREAS, the Town of Jay has been informed by Santa Rosa County Emergency Management Staff of the imminent threat posed by, “January Winter Weather Storm”; and

WHEREAS, January Winter Weather Stonn poses a significant, imminent, and dangerous threat to the health, safety, and welfare of the inhabitants, visitors and tourists of the Town of Jay in Santa Rosa County, Florida, as well as their real and personal property; and

WHEREAS, Florida Governor DeSantis has issued a Declaration of Emergency Executive Order Number 25-13, by virtue of the authority in Article IV, Section l(a) of the Florida Constitution and by the Florida Emergency Management Act, as amended, and all other applicable laws, due to the imminent danger of hazardous winter weather and related severe weather conditions; and

WHEREAS, Santa Rosa County has declared a Local State of Emergency due to the imminent danger of hazardous winter weather and related severe weather conditions; and

WHEREAS, the Mayor of the Town of Jay has conferred with the Town Manager and has been informed of risks facing the Town and considered whether or not to declare a state of local emergency; and

NOW THEREFORE, the Mayor of the Town of Jay, hereby resolves, finds, and declares that effective January 21, 2025, 8:00 am CDT, until further action by the Mayor or the Town Council of the Town of Jay, as follows:

  1. The above recitals are true and are incorporated herein.
  2. In light of the serious threat to the residents and property of the Town of Jay, a state of local emergency is hereby declared in the Town of Jay.
  3. The Mayor hereby waives the procedures and formalities otherwise required of the Town of Jay pertaining to:
    a. Performance of public work and taking whatever prudent action is necessary to ensure the health, safety, and welfare of the community.

b. Entering into contracts.

c. Incurring obligations.

d. Employment of permanent and temporary workers.

e. Utilization of volunteer workers.

f. Rental of equipment.

g. Acquisition and distribution, with or without compensation, of supplies, materials, and facilities.
h. Appropriation and expenditure of public funds.

  1. The Town Manager, or his designee, is hereby empowered, authorized, and directed to exercise, on behalf of the Town, such emergency powers adopted by the Town in its Disaster Emergency Response Plan and such emergency powers necessary to carry out the provisions of Chapter 252, Florida Statutes, including, but not limited to, the powers to direct and compel evacuation of all or part of the population from stricken or threatened areas within the Town, if such action is deemed necessary to reduce the vulnerability of people in community of the Town of Jay to damage, injury, and loss of life and property resulting from the imminent threat, as well as any other powers expressly or implicitly confined pursuant to Chapters 166 and 252, Florida Statutes, and any other provision of law or Town ordinance.
  2. The Town’s Disaster Emergency Response Plan is hereby activated.
  3. This Resolution shall be transmitted to the Administrator of Santa Rosa County and the Secretary of State upon adoption.
  4. This authority shall extend only for the period of the state of local emergency as determined by the Mayor, or until further action by the City Council terminates such authority or declares that the state of local emergency has ended.
  5. This Resolution shall take effect immediately upon its adoption.

ADOPTED THIS 21st DAY OF JANUARY 2025.
