    Cyber Crimes in Singapore

    In Singapore, cyber crimes are governed by the Computer Misuse Act. There are a number of offences that fall under this Act.

    Sentencing Guide

     

    Section 3 – Unauthorised access to computer material

    If found guilty, the accused will be liable on first conviction to

    a) A fine of up to $5,000; or
    b) Imprisonment for up to 2 years; or
    c) Both.

    For second or subsequent convictions, accused will be liable to

    a) A fine of up to $10,000; or
    b) Imprisonment for up to 3 years; or
    c) Both.

    If any damage is caused as a result of an offence under this section, a person convicted of the offence shall be liable to

    a) A fine not exceeding $50,000; or
    b) Imprisonment for a term not exceeding 7 years; or
    c) Both.

    Section 4 – Access with intent to commit or facilitate commission of offence

    When a person uses a computer to secure access to any program or data with the intent to commit an offence.
    Any person found guilty may be liable on conviction to

    a) A fine not exceeding $50,000; or
    b) Imprisonment for a term not exceeding 10 years; or
    c) Both.

    Section 5 – Unauthorised modification of computer material

     

    Section 6 – Unauthorised use or interception of computer service

     

    Section 7 – Unauthorised obstruction to use of computer

    If found guilty, the accused will be liable on first conviction to

    a) A fine of up to $10,000; or
    b) Imprisonment for up to 3 years; or
    c) Both.

    For second or subsequent convictions, accused will be liable to

    a) A fine of up to $20,000; or
    b) Imprisonment for up to 5 years; or
    c) Both.

    If any damage is caused as a result of an offence under this section, a person convicted of the offence shall be liable to

    a) A fine not exceeding $50,000; or
    b) Imprisonment for a term not exceeding 7 years; or
    c) Both.

    Section 8 – Unauthorised disclosure of access code

    If found guilty, the accused will be liable on first conviction to

    a) A fine of up to $10,000; or
    b) Imprisonment for up to 3 years; or
    c) Both.

    For second or subsequent convictions, accused will be liable to

    a) A fine of up to $20,000; or
    b) Imprisonment for up to 5 years; or
    c) Both.

    Section 9 – Enhanced punishment for offences involving protected computers

    Where access to any protected computer is obtained in the course of the commission of an offence under section 3, 5, 6 or 7. A person convicted of such an offence shall, in lieu of the punishment prescribed in those sections, be liable to

    a) A fine of up to $100,00; or
    b) Imprisonment of up to 20 years; or
    c) Both.
