Goldin Criticizes 'Amok' Builders By Dawn Smith City Comptroller Harrison J. Goldin yesterday once again called for a stop-work order on Harry Macklowe's 44th Street hotel construction site, criticizing Macklowe and others as "developers gone amok." In a Jan. 24 memo to Edward I. Koch, Goldin, a possible mayoral candidate, first urged the mayor to direct Buildings Commissioner Charles M. Smith to issue a stop-work order on the Hotel Macklowe. Situated between Sixth and Seventh Avenues, the site in question was illegally cleared of four old buildings, two of which were SRO hotels, by Macklowe on Jan. 7, 1985, two days before a ban on demolition of such structures was to take effect. Macklowe was fined $2 million, as well as a four-year construction suspension. But a constitutionality question allowed the suspension to be lifted in 1987, and Macklowe began work on his proposed 43-story hotel, which currently has more than 30 floors. Macklowe was allowed to build his hotel 20 percent higher than Times Square zoning laws allow. "Harry Macklowe and this project signal a lot that's wrong with developing in New York," Goldin said, standing across the street from the structure. "Developers think they can ignore rules." Macklowe could not be reached for comment. In a pre-taped CBS-TV "Newsmakers" broadcast aired yesterday morning, Goldin said, "I think the Macklowe situation is symptomatic of developers gone amok.' Joseph Rose, the Community Board 5 construction chairman who accompanied Goldin yesterday, said "It sends out this message to developers: Go ahead and break the law and then come in and negotiate the price."
