Mario is Missing! (1993,Super Mario-related media)
“The farcical, childlike and nonsexualDonkey Kong creates a humorous impression by jumping up and down and strutting back and forth to teaseMario. The Donkey Kong gorilla is thus quite different from King Kong, a ferocious gorilla in quest of a beautiful woman who goes on rampages, chases people, crushes them underfoot, or throws them to the ground, and fights with dinosaurs, giant snakes, airplanes and helicopters, all culminating in his tragic and bloody death.”
Judge Robert W. Sweet,Universal City Studios, Inc. v. Nintendo Co., Ltd.

King Kong is a fictional giant ape and the antagonist of thefilm of the same name, as well as the inspiration forDonkey Kong. In 1982, King Kong was the subject of alawsuit againstNintendo byUniversal Studios, who claimed that thecharacter and scenario of the gameDonkey Kong infringed on Universal's rights to the King Kong character. The turnout was, among other reasons, decided through acknowledgement that King Kong was a public-domain character, allowing him to make appearances in someSuper Mario media.
