🚨 Breaking: Compass has sued Zillow for "gatekeeping" home listings and breaking federal antitrust laws. The suit, filled in New York this morning, accuses Zillow of engaging in an anticompetitive conspiracy to maintain a monopoly over digital home listings. Zillow is effectively enforcing NAR's Clear Cooperation Policy, banning any listing that doesn't hit the MLS within a full business day of being publicly marketed. Zillow says this is about transparency, and Compass says it's about seller choice. It's really about who controls listings data and how it can be monetized.

Zillow unveiled a new rule last week that could blacklist scores of homes from its popular search website. The goal is to root out "exclusive inventory" — homes advertised for sale on one website but not shared everywhere. The top exec at rival Homes.com called Zillow's new rule a "pure power play of epic proportions." Compass CEO Robert Reffkin Redfin told his agents to "keep doing what you're doing," encouraging sellers to test the waters in a more private setting before sharing listings widely. But Zillow has plenty of power players on its side. Big brokerages like eXp Realty and NextHome, Inc. have committed to following the new policy. And Redfin has said it will also ban homes advertised on one site but not others. Two major NYC landlords opened their books to Bisnow's Sasha Jones, exposing just how broken the economics of rent-stabilized housing have become under the 2019 Housing Stability and Tenant Protection Act. Across 4,300 apartments, net operating income has plunged, insurance and taxes have doubled and the losses are mounting — to the tune of $4M in just two years for one nonprofit. Vacancy spikes, deferred repairs and building defaults are increasingly common, with property values down more than 50% in some boroughs.
