BOOK I :GENERALNORMS (Cann.1 -6) Can.1 Thecanons of thisCodeconcern only thelatinChurch. Can.2 For the mostpart theCode does notdetermine therites to beobserved in thecelebration ofliturgicalactions.Accordingly, liturgicallaws which have beenineffecthithertoretain theirforce, except those whichmay becontrary tothecanons of theCode. Can.3 Thecanons of theCode do notabrogate, nor do theyderogate from, agreementsentered into by theApostolicSee withnations or othercivilentities. Forthisreason, theseagreementscontinue inforce ashitherto, notwithstandinganycontraryprovisions of thisCode. Can.4Acquiredrights, andlikewiseprivilegeshithertogranted by theApostolicSee to eitherphysical orjuridicalpersons, which are still inuse and havenot beenrevoked, remainintact, unless they areexpresslyrevoked by thecanons of thisCode. Can.5 §1Universal orparticularcustoms which have been ineffect up to now butarecontrary to theprovisions of thesecanons and arereprobated in thecanonsof thisCode, arecompletelysuppressed, and theymay not beallowed torevivein thefuture. Othercontrarycustoms are also to beconsideredsuppressed, unless theCodeexpresslyprovides otherwise, or unless they arecentennial orimmemorial: these lattermay betolerated if theOrdinaryjudges that, in thecircumstances ofplace andperson, they cannot beremoved. §2Customsapart from thelaw, whetheruniversal orparticular, which have been ineffecthitherto, areretained. Can.6 §1 When thisCodecomes intoforce, thefollowing areabrogated: 1° theCodeofCanonLawpromulgated in1917; 2° otherlaws, whetheruniversal orparticular, which arecontrary to theprovisions ofthisCode, unless it is otherwiseexpresslyprovided inrespect ofparticularlaws; 3° allpenallawsenacted by theApostolicSee, whetheruniversal orparticular, unlessthey areresumed in thisCode itself; 4° anyotheruniversaldisciplinarylawsconcerningmatters which areintegrallyreordered by thisCode. §2 To theextent that thecanons of thisCodereproduce the formerlaw, they are to beassessed in thelight also ofcanonicaltradition. |
