2022-11416 People (Ocampo) Motion to Compel 7/1/2025 Plaintiff, The People of the State of California, bring a Motion to Compel Further Discovery Responses to Request for Production of Documents, Set No. 2. Having read the moving papers, the opposition papers, and reply papers, the court issues the following tentative ruling: Appearances Required. The parties may attend the hearing remotely via the Dept. 11B Dedicated Bridge Line. To attend the hearing remotely dial (209) 992-5590 and follow the prompts entering Bridge NO. 6941 and Passcode 5564. To aid the parties with the discussion the court issues the following guidance, if the claimant is going to invoke the Tax Return Privilege then plaintiff will not be able to rely on any non-produced documents or argument regarding what those documents may or may not evidence at trial. Invoking the privilege to prevent disclosure may not be used as a sword if it is used as a shield to prevent production. If plaintiff invokes the privilege then Motion to Compel Further Responses to Request Nos. 2, 4 is denied as to tax returns. However, if claimant has non-privileged documents those documents must be produced. Claimant to provide a privilege log. Motion to Compel Further response to Request for Production Nos. 3, 5, 6, and 7 are GRANTED, as they seek information that is reasonably likely to lead to the discovery of admissible evidence. Further responses due within 30 days of service of order. If documents are not being produced due to claimed privilege, claimant to provide privilege log. WATERS 6/30/2025 Directions for Contesting or Arguing the Tentative Ruling: Tentative rulings for Law and Motion will be posted electronically by 1:30 p.m. the day before the hearing. Any party wishing to contest or argue the tentative ruling must email the court at civilcourtclerks@sjcourts.org. that they intend to appear remotely no later than 4:00 PM on the day before the scheduled hearing. The Department, Case number, Case Name, and party’s name must be in the header of the email.
