Abstract

The U.S. District Court for the Northern District of Florida agreed with a state court order that had compelled a pregnant woman to undergo a cesarean section against her wishes. The court ruled that the cesarean section at the conclusion of a full-term pregnancy had been medically necessary to avoid a substantial risk that the child would die during delivery, and that a state's interest in preserving the life of an unborn child outweighed the mother's constitutional interest of bodily integrity.
