    This edited work collates novel contributions on contemporary topics that are related to human rights. The essays address analytic-descriptive questions, such as what legal personality actually means, and normative questions, such as who or what should be recognised as a legal person. As is well-known among jurists, the law has a special conception of personhood: corporations are persons, whereas slaves have traditionally been considered property rather than persons. This odd state of affairs has not garnered the interest of legal theorists (...) for a while and the theory of legal personhood has been a relatively peripheral topic in jurisprudence for at least 50 years. As readers will see, there have recently been many developments and debates that justify a theoretical investigation of this topic. Animal rights activists have been demanding that some animals be recognized as legal persons. The field of robotics has prompted questions about driverless cars: should they be granted a limited legal personality, so that the car itself would be responsible for damages? This book explores such concepts and touches on matters of bioethics, animal law and medical law. It includes matters of legal history and appeals to both legal scholars and philosophers, especially those with an interest in theories of law and the philosophy of law. (shrink)

    Ethical Review of Animal Research and the Standards of Procedural Justice: A European Perspective.Tomasz Pietrzykowski -2021 -Journal of Bioethical Inquiry 18 (3):525-534.
    Committees established for the ethical review of research involving animals have become a widespread legal standard around the world. Despite many differences in their composition, powers, and institutional settings, they share many common problems related to the well-established standards of procedural justice in administrative practice. The paper adapts the general theory of procedural justice to the specific context of ethical review committees. From this perspective, the main concerns over the procedural aspects of the ethical evaluation of research projects are identified (...) and examined. They include in particular the standards of the committees’ composition, impartiality, fair hearing, appeal, transparency, and benevolence. Their proper reflection in the regulatory regimes of animal ethics committees is necessary to secure the standards of fairness of the ethical review itself. This, in turn, is a condition of the moral and social legitimacy of all administrative and quasi-administrative procedures, including the committees’ operations. (shrink)

    The age of intellectual debates in France between the Revolution in 1789 and the Dreyfus Affair at the turn of the centuries is one of the key sources that enable the understanding of the modern political culture. It concerns, in particular, the modern concept of liberty that became one of the defining values shaping the European political discourse. Thus, the post-revolutionary France remains an extremely valuable source of inspiration when revisiting the essence of many contemporary debates in political philosophy and (...) public discourse. Most of the ideas and arguments in circulation today echo the debates over the liberty, reason, and society that dominated the intellectual climate of that period in the French political history or, at least, heavily depend on the foundational ideas formulated then and there.
