IntroductionAfter three decades of the absolute prohibition of abortion, Chile enacted Law 21,030, which decriminalizes voluntary pregnancy termination when the person is at vital risk, when the embryo or fetus suffers from a congenital or genetic lethal pathology, and in pregnancy due to rape. The law incorporates conscientious objection as a broad right at the individual and institutional levels.ObjectivesThe aim of the study was to explore the exercise of conscientious objection in public health institutions, describing and analyzing its consequences and (...) proposals to prevent it from operating as structural violence.Materials and methodsThis study uses a qualitative, post-positivist design. At the national level, according to the chain technique, people who were identified as key actors due to their direct participation in implementing the law were included. Grounded theory was used to analyze the information obtained through a semi-structured interview. The methodological rigor criteria of transferability or applicability, dependability, credibility, auditability, and theoretical-methodological adequacy were met.ResultsData from 17 physicians, 5 midwives, 6 psychologists, 8 social workers, 2 nursing technicians, and 1 lawyer are included. From an inductive process through open coding, conscientious objection as structural violence and strategies to minimize the impact of objection emerge as meta-categories. The first meta-category emerges from the barriers linked to the implementation of the law, the infringement of the rights of the pregnant person, and pseudo conscientious objection, affecting timely and effective access to pregnancy termination. The second meta-category emerges as a response from the participants, proposing strategies to prevent conscientious objection from operating as structural violence.ConclusionConscientious objection acts as structural violence by infringing the exercise of sexual and reproductive rights. The State must fulfill its role as guarantor in implementing public policies, preventing conscientious objection from becoming hegemonic and institutionalized violence. (shrink)

Refiere a la confluencia de múltiples organizaciones (asociaciones inmigrantes, ONGs, grupos anti-globalización, sindicatos, etc.), quienes son conscientes de la necesidad de transnacionalizar sus acciones de cara a contrarrestar las políticas neoliberales de control de fronteras y provisión de mano de obra provenientes desde la Unión Europea.

En los últimos tiempos el derecho ambiental ha ganado un puesto importante en el ámbito jurídico, hecho que refleja la preocupación que hoy se tiene por la relación del hombre con su entorno. Desde hace quince años, la Universidad Colegio Mayor de Nuestra señora del Rosario, por intermedio de su Facultad de Jurisprudencia y concretamente de la Especialización y la línea de investigación en Derecho Ambiental, ha propuesto a través de diversos proyectos avanzar en el conocimiento y análisis del ordenamiento (...) jurídico ambiental, aportando así al desarrollo, estructura y consolidación de esta rama jurídica. Bajo estos parámetros, el objetivo de esta publicación es hacer algunas reflexiones en torno a distintos temas que dentro del derecho público impactan o influyen al derecho ambiental y responder a los enormes desafíos que se presentan en la materia. Por tanto, el programa quiere contribuir desde la academia al diálogo crítico y propositivo que permita dar solución a los problemas encontrados en la aplicación del derecho ambiental. En el primer capítulo, Gloria Amparo Rodriguez describe los ordenamientos jurídicos constitucionales de Colombia, Ecuador y Bolivia a fin de analizar la forma en que cada uno de ellos consagra el derecho a un ambiente sano. A continuación, Martha Ovalle y Zelba Nidia Castro de Perez realizan un estudio de los principios de precaución y prevención, exponiendo su alcance, su fundamento desde el derecho internacional y cómo vienen siendo entendidos por nuestro ordenamiento jurídico, tanto jurisprudencial como legal. Luis Adolfo Diazgranados se ocupa de la responsabilidad de los funcionarios públicos en materia ambiental, para lo cual realiza un análisis de los deberes consagrados en la normatividad vigente. Continuando con esta temática, el profesor Jorge AgudoGonzalez, de la Universidad Autónoma de Madrid, explora la incidencia del ambiente y los recursos naturales en los procesos contractuales, a fin de mostrar cómo estas materias se han constituido en variable fundamental en el devenir de la formación, celebración y ejecución de los contratos, desde un punto de vista crítico, los aspectos importantes del proceso sancionatorio ambiental, evidenciando las falencias y vacios del a Ley 1333 de 2009. Jairo Cabrera plantea algunas reflexiones sobre la responsabilidad, valiéndose de la doctrina internacional, sobre la problemática de la reparación por daño ambiental. Por su parte, Leonardo Güiza Suárez explica el régimen general de la responsabilidad ambiental en el ordenamiento jurídico a partir del daño de los bosques naturales y su incidencia sobre los derechos humanos. Andres Gomez Rey, desde la teoría del acto administrativo, desarrolla el análisis crítico del régimen jurídico de las aguas superficiales en el derecho ambiental. Giovani J. Herrera Carrascal realiza una disertación sobre los recursos naturales y el ambiente como elementos del espacio público que a su vez constituye en un componente del medio ambiente urbano a partir de la jurisprudencia y de las competencias respectivas. Por último, Marybell Ochoa Miranda trate el tema de los residuos hospitalarios en Colombia, exponiendo su régimen jurídico, las competencias de las autoridades ambientales, los deberes que en estos asuntos tienen los ciudadanos, proponiendo lineamientos para avanzar en la consolidación de la gestión integral de residuos hospitalarios y similares. RESUMEN La medicina tradicional herbolaria desde su evolución hasta la contemporaneidad ha sido objeto de uso para la medicina convencional. Por eso el objetivo del trabajo es describir el comportamiento de la medicina tradicional herbolaria en los sistemas de salud convencionales. Se realizó la búsqueda y análisis documental de numerosas fuentes sobre la temática pertenecientes a las bases de datos SciELO Cuba, SciELO Regional, Science Direct, Clinical Key, Cumed, Lilacslo. Se concluye que la actualidad social registra manifestaciones alentadoras en el (...) campo de la aceptación de la herbolaria como medicina complementaria por el equipo de salud y un renovado interés en el ámbito mundial por estudiar los efectos que tienen las plantas sobre la salud. ABSTRACT The traditional herbalist medicine from its evolution to the contemporaneity has been an object use for the conventional medicine. That's why the objective of the work is to describe the behavior of the traditional herbalist medicine in the conventional health systems. A search and documentary analysis of numerous sources on the subject-matter belonging to the databases SciELO Cuba, SciELO Regional, Science Direct, Clinical Key, Cumed, Lilacslo was carried out. It is concluded that the social actuality registers encouraging declarations in the field of the acceptance of the herbalist as complementary medicine for the team of health and a renewed interest in the world ambience to study the effects that have the plants on the health. We present a conceptual model of the ways in which built and social environments shape the development of self-regulation in early childhood. Importantly, in centering children of color growing up in historically disinvested neighborhoods, we first describe how systemic structures of racism and social stratification have shaped neighborhood built and social environment features. We then present evidence linking these neighborhood features to children’s development of self-regulation. Furthermore, we take a multilevel approach to examining three potential pathways linking neighborhood contexts to (...) self-regulation: school environment and resources, home environment and resources, and child health behaviors. Finally, we consider how racial-ethnic-cultural strengths and multilevel interventions have the potential to buffer children’s development of self-regulation in disinvested neighborhood contexts. Advancing multilevel approaches to understand the development of self-regulation among children of color living in historically disinvested neighborhoods is an important step in efforts to promote equity in health and education. Some philosophers think that anti-realism about de re necessity entails anti-realism about the individuation and identity of objects. In this paper I address one argument for this view, due to Sidelle, according to which the only way in which a de re modal conventionalist can avoid being refuted by a well-known argument based on the contingency of conventions is by also accepting conventionalism about objects. I show that Sidelle’s argument is not successful and, in this way, I also show that (...) the combination of de re modal anti-realism and realism about objects is at least not threatened from this direction. This explorative article conceptualizes the myth as a cultural locus where different concepts are ordered forming semantic networks and as a social narrative reflecting emotional predispositions toward the social significance of an episode in the past. The article analyzes the semantic network formed within the Arthurian myth by the concepts Britain and imperium. It identifies a persistent semilogical dynamic between both concepts but shifting emotional responses and temporalities: loss and longing among the Welsh (sixth century to eleventh century), fixing the (...) memory in the past; joy among the English (twelfth century to fifteenth century), bringing the memory into the present; and anxiety and desire among Welsh and English (sixteenth century) projecting the memory to the future. During the seventeenth century, the semantic network left the Arthurian myth, which fell into a relative oblivion. (shrink)

Emotions are taken by some authors as a kind of mental state epistemically akin to perception. However, unlike perceptual phenomenology, which allows being treated dogmatically, emotional phenomenology is puzzling in the following respect. When you feel an emotion, you feel an urge to act, you feel, among other things, your body’s action readiness. On the other hand, at least sometimes, you are aware that an emotion by itself is not a sufficient reason to justify an evaluative judgment and/or an action, (...) not even prima facie. How can a single mental state, emotion, seem to be dogmatic and hypothetic at the same time? It seems that emotions alone fall short of the justifying role in which their guiding role would be grounded. If this is true, then emotional experience cannot be epistemically akin to perception. Unless we are willing to claim that emotions cause action blindly (i.e., not rationally), we need an account of the distinctive epistemic role of emotional experience that renders its guidance role rational. In this paper I outline this new problem and its consequences for the metaphysics and epistemology of emotional experience. I also try to offer the sketch of a plausible solution. (shrink)

In recent years, the study of musical cultures has gained popularity as a curricular intervention for increasing cultural diversity in school music curricula. Informed by Michel Foucault’s analytics of power-as-effects, this paper examines some of the underlying epistemic premises of the notion of musical culture as it operates in music curricula. Additionally, it considers how this construct’s discursive effects align with or contradict its presumed contribution to cultural inclusivity. I use the International Baccalaureate high school music curriculum as my exemplar (...) because of the key role that the notion of musical culture plays in this increasingly popular curriculum. First, I contextualize the notion of musical culture socio-historically, pointing to this construct’s Euro-Americentrism. Second, I argue that musical culture leans toward musical formalism. Third, I examine musical culture’s presumed distinctiveness, indicating discursive connections to a nineteenth-century, Euro-American conceptualization of cultures as fixed and discrete. Fourth, I examine musical culture’s presumed comparability, suggesting that the construct indirectly embraces Euro-American high art music as its frame of reference for analyzing all cultures. Based on this analysis, I suggest approaching the study of musical cultures relationally to render visible the dynamics of power and privilege that shape them. Finally, I consider the potential of abandoning the notion of musical culture altogether in favor of approaches that eschew establishing cultural boundaries. (shrink)

Es indudable que Edith Stein representa, en nuestros días, una figura tan atractiva como compleja, debido a su multifacético itinerario existencial caracterizado por la presencia de distintos registros tanto a nivel personal como a nivel profesional. En el presente artículo nos interesa destacar los principales legados de Edith Stein al mundo, a 130 años de su nacimiento. De manera general, nos proponemos dar cuenta de los legados que consideramos fundamentales por la potencia de sus propuestas, por la pertinencia para nuestro (...) mundo actual y por la recepción que de ellos se haga. Los legados seleccionados son: 1) el legado filosófico; 2) el legado pedagógico; 3) el legado femenino y 4) el legado personal y espiritual. Esperamos que durante la exposición de los legados puedan emerger los motivos de nuestra elección, así como las razones de inclusión y exclusión de temas en determinado legado, o la ausencia de alguna otra herencia importante que se haya dejado pasar. We expose some representations and practices related to the natural environment among Nahua peasants in a village located at the western boundary of Puebla and Guerrero states, in Mexico. Information was obtained by individual interviews and focal groups' work, following an open guide with ecological items considered as rooted in Mesoamerican cultures. The use of some local, vegetal resources, and the local perception of changes, mainly in the water availability, is documented. Survival strategies involve ancestral representations and material products, and (...) entail a high grade of pragmatism. “Natural environment” is framed in a local culture that involves relational and sacred dimensions, usually omitted in other approaches. Hence, for the Temalac peasants, there is no dissection, at an operative level, between “natural facts” and personal or social ones, being these often considered as determinant for the quality and accessibility of resources and weather conditions. We discuss the challenge for these elements posed by a growing migration rate and an increasing external influence. (shrink)

Synaesthesia is a condition in which one type of stimulation evokes the sensation of another, as when the hearing of a sound produces photisms, i.e. mental percepts of colours. R is a 20 year old colour blind subject who, in addition to the relatively common grapheme-colour synaesthesia, presents a rarely reported cross modal perception in which a variety of visual stimuli elicit aura-like percepts of colour. In R, photisms seem to be closely related to the affective valence of stimuli and (...) typically bring out a consistent pattern of emotional responses. The present case study suggests that colours might be an intrinsic category of the human brain. We developed an empirical methodology that allowed us to study the subject's otherwise inaccessible phenomenological experience. First, we found that R shows a Stroop effect elicited by photisms despite the fact that he does not show a regular Stroop with real colours. Secondly, by manipulating the colour context we confirmed that colours can alter R's emotional evaluation of the stimuli. Furthermore, we demonstrated that R's auras may actually lead to a partially inverted emotional spectrum where certain stimuli bring out emotional reactions opposite to the normal ones. These findings can only be accounted for by considering R's subjective colour experience or qualia. Therefore the present paper defends the view that qualia are a useful scientific concept that can be approached and studied by experimental methods. (shrink)

Esta investigación tiene como finalidad responder, desde la filosofía y literatura de Camus, la pregunta de si el hombre puede ser feliz sin Dios. Para llevar a cabo este trabajo, se utiliza un método hermenéutico, pues se hace un acercamiento dialógico y holístico a las obras del pensador argelino para descubrir su pensamiento respecto a Dios y a la felicidad humana. Los principales resultados de la investigación concluyen que el hombre puede ser feliz sin Dios en la medida en que, (...) en primer lugar, acepte el absurdo y viva su rebeldía, y, en segundo lugar, comprenda la felicidad como una vocación ontológica más allá de un estado. La sura de La Caverna (al-Kahf) es uno de los espacios simbólicos más vibrantes y fascinantes de todo el texto coránico. Esta sura recoge cuatro grandes narraciones simbólicas e interculturales con claras referencias a la tradición judía (Mishná, Talmud), al mundo clásico (los durmientes de Éfeso, Alejandro Magno) y a la antigüedad tardía (las visiones del mundo siriaco) en un contexto puramente intercultural. Unas narraciones que trascienden desde lo histórico hacia lo metahistórico, elaboradas en un tiempo kairológico y que conducen (...) al lector a reflexionar sobre el triunfo de lo simbólico, el problema del mal y la insondabilidad de las decisiones divinas. Sobre este contexto, el objetivo de esta ponencia es reflexionar filosóficamente sobre cómo todos estos elementos se convierten en un profundo diálogo intercultural y metahistórico dentro la experiencia profética coránica que revive el creyente en su lectura. En el sufismo la experiencia visionaria (ru’ya) es uno de los principales métodos de conocimiento profundo de la realidad (ḥaqīqa). La visión verídica (ru’ya ṣadīqa) y la visión despierta (ru’ya fi-l yaqẓa) son las principales vías de acceso al mundo imaginal (‘ālam al-mithāl) y a la hermenéutica vital que se desprende de estas experiencias. Este trabajo recoge y analiza desde una perspectiva filosófica las principales experiencias visionarias de uno de los más importantes personajes de la ṭarīqa Tijāniyya, Aḥmad Tijāni, comparándolas (...) ambas con los planteamientos y vivencias de Muḥy al-dīn Ibn ‘Arabī sobre la experiencia visionaria. SARS and monkeypox have given the public health community a unique opportunity to examine the use of quarantine measures. Until recently, the word “quarantine”was not used in polite conversation, and evoked unsavory images. The recent SARS epidemic illustrated the important role of quarantine and isolation as a public health response to communicable disease.As public health officials in Toronto began to take control of the SARS epidemic, a second wave of the disease emerged. In the first SARS epidemic, approximately 8,200 individuals (...) were isolated. There were approximately 82 probable cases, 66 suspect cases, and 24 deaths. On May 22, 2003, SARS II emerged. In total, approximately 13,000 people were quarantined. SARS II saw the onset of difficult questions being asked about the control and spread of SARS.The province of Ontario establishes the public health policies and legislative framework for the entire province. Jackendoff's Foundations of Language: Brain, Meaning, Grammar, Evolution attempts to reconnect generative linguistics to the rest of cognitive science. However, by minimally acknowledging decades of work in cognitive linguistics, treating dynamical systems approaches somewhat dismissively, and clinging to certain fundamental dogma while revising others, he clearly risks satisfying no one by almost pleasing everyone.

La presente investigación se propone mostrar que la rehabilitación del ser sensible realizada por la filosofía de Merleau-Ponty es comprensible a partir de una dimensión originariamente virtual. Para esto se plantea una primera descripción del ser sensible a partir de su latencia constitutiva, colocando atención al desplazamiento de su definición que va desde lo dado a la percepción hacia lo que viene-a-ser en su transaparecer. De tal modo, el ser sensible no es originariamente la pura presencia, antes de esto el (...) ser sensible se comprenderá a partir de un proceso de diferenciación entre lo visible y lo invisible. Así, el sentido del ser sensible viene a expresión medialmente, en la medida en que lo sensible es una singularización de un trasfondo operativamente virtual. Finalmente, la presencia singularizada en la experiencia del cuerpo propio y de toda experiencia sensible adquiere un sentido a modo de constante actualización de potencias virtuales, que abren al mundo como permanente desborde, desajuste y descentramiento.
