- Perspectivas de la violencia de género en la era de la Teoría Neoconstitucional como el nuevo paradigma del Derecho Internacional de los Derechos Humanos = Perspectives of gender violence in the age of Neoconstitutional Theory as the new paradigm of the International Law of Human Rights.MaríaBelénRedondo -2018 -UNIVERSITAS Revista de Filosofía Derecho y Política 28:38-58.RESUMEN: Los cambios en la nueva concepción del Estado Democrático de Derecho que surgen a partir de la toma de conciencia de la existencia de determinados derechos que se consideran como fundamentales por la comunidad internacional, influyen de modo directo en el diseño de políticas públicas, de creación de normas jurídicas y en el modo de resolver los casos judiciales. Es así que se presenta a la Teoría Neoconstitucional como una nueva teoría del derecho que permite integrar los derechos con (...) sus respectivas garantías, y que se ocupa tanto de las normas como de los principios y los valores de Derechos Humanos y de su internalización en los ordenamientos de los Estados, es decir, se ocupa del fenómeno de mundialización de estos derechos. Dentro de los derechos fundamentales encontramos los que poseen las mujeres en lo que concierne a vivir una vida libre de toda violencia en la que se respete su dignidad y autonomía de la voluntad, amén de que los índices de violencia contra ellas aumentan día a día en todos los países del mundo. De este modo los Estados deberán cumplimentar con las medidas de acciones positivas tendientes a garantizar el efectivo goce de los derechos reconocidos por los Pactos internacionales de Derechos Humanos.ABSTRACT: The changes in the new conception of the Democratic State of Law that arise from the awareness of the existence of certain rights that are considered fundamental by the international community, have a direct influence on the design of public policies, the creation of legal norms and how to solve judicial cases. This is how the Neoconstitutional Theory is presented as a new theory of law that allows integrating rights with their respective guarantees, and that deals with both the norms and the principles and values of Human Rights and their internalization in the legal systems. of the States, that is, deals with the phenomenon of globalization of these rights. Within the fundamental rights we find those that women possess in what concerns to live a life free of all violence in which their dignity and autonomy of the will is respected, in addition to that the indices of violence against them increase every day in all the countries of the world. The idea is to contribute to the creation of a corpus that overcomes the technological tradition responding to three challenges: the creation of inclusive and collaborative processes with subjects, the transformation of diagnosis and intervention techniques in research resources, and the inclusion of symbols as an inseparable dimension from (...) everyday practices and social structures of the subjects of study and intervention. Desde el trabajo social asumido como transdisciplina se pretende reflexionar sobre las bases complejas necesarias para abrir caminos hacia una teoría de la intervención, construida desde una investigación coherente y orgánica a la profesión. Desarrollaremos la presencia de la melancolía en la novela ligada a su componente crítico. También nos proponemos analizar una reflexión acerca del lugar que ocupa la militancia del protagonista y la política como un objeto de deseo perdido en la obra.: Natalia Ginzburg’s epistolary novel Caro Michele [1973] (...) addresses, like several of the late works of the author, the decadence of the petty bourgeoisie and the crisis of the traditional institution of the family. We will develop the presence of melancholy in the novel linked to its critical component. - How Do Technological Systems Define Who War Victims Are?MaríaBelén Albornoz &Javier Andrés Jiménez Becerra -2023 -Perspectives on Science 31 (1):186-205.In a range of peace process scenarios, the expert’s knowledge has become a fundamental tool for generating information systems as a mechanism for the storage and circulation of data. These information artifacts are supposed to faithfully document situations of human rights violations and contribute to the design of public policy and the construction of collective memory. Following Latour’s (1993) original coinage of the term coproduction, this paper analyzes how the Inter-Institutional System of Information for Justice and Peace (SIIJYP)1 was designed (...) to define victims of war and means of reparation from the State in Colombia. From an actor network theory perspective, we explain how victimizers become the main beneficiaries of the application of the SIIJYP. To comprehend this unintended social impact of the technological artifact and how it becomes an artifact that functions as an aseptic mediator of the historical-judicial truth, and the policy of transitional justice, we examine the relations between human and nonhuman actors, how information is collected, organized, hierarchized, and negotiated, as well as the consequences of the technical and legal construction of the notion of victims of war. - Rethinking the metaphor of light:María Zambrano in dialogue with Jacques Derrida and Hans Blumenberg.MaríaBelén Castañón Moreschi -2018 -History of European Ideas 44 (7):913-924.ABSTRACTThe notion of metaphor has been broadly discussed during the twentieth century as an essential and necessary part of language and history. This article examines the theoretical dialogue that links the centrality of the metaphor of light in the work ofMaría Zambrano with reflections on this topic by Jacques Derrida and Hans Blumenberg. Through various formulations of this metaphor across different works, Zambrano presents the metaphor linked to poetic reason as not reducible to a mere rhetorical ornament or (...) to a concept. By articulating alternative metaphors to the imperative of clarity as the blinding light of Occidental reason, Zambrano introduces a solid critique to rationalism and introduces the metaphor of the Dawn as a new form of knowledge. This new intonation of the metaphor of light opens up an unexplored direction in Spanish thought not only by thinking the metaphor of light through poetic reason and its critique to the philosophical tradition, but also by assuming the political implications of this metaphor and criticizing its heliopolitical configuration. Indeed, Zambrano states the significance of the metaphor of the sun linked to the sacrificial structure of history, particularly of Spain, and its necessary overcoming as the possibility of a radical democracy. - Cuerpos, territorios y gubernamentalidad neoliberal. Miradas sobre los regímenes extractivistas desde la epistemología feminista.Martín Ezequiel Diaz &MaríaBelén Alvaro -2020 -Astrolabio: Nueva Época 25:249-273.En este trabajo, analizamos los efectos de los regímenes extractivistas en los territorios y los cuerpos desde el lugar situado de las mujeres. Centramos el análisis en la ciudad de Allen (Río Negro), a partir de la conversión de su territorio frutícola en área de extracción de hidrocarburos no convencionales. Hipotetizamos que la gubernamentalidad neoliberal que se impone en estos territorios arrasados genera una crisis de la reproducción social que impacta en el trabajo vivo útil para la producción y reproducción (...) de la vida humana; y que son las mujeres, en tanto subjetividades históricamente subalternizadas y relegadas a la esfera reproductiva, quienes pueden dar cuenta de los despojos del extractivismo desde miradas que trascienden las dicotomías de la modernidad: público / privado, Estado / mercado, productivo / reproductivo. Nos situamos en la epistemología feminista para analizar las narrativas de mujeres que habitan territorios de despojo desde los cuales ellas hacen posible la vida. Nos interesa aportar al conocimiento de los efectos de los regímenes extractivistas desde la producción y circulación de sentidos “otros” acerca de sus impactos, construidos en las intersecciones de género, clase y territorio. A partir de rondas de entrevistas bajo la modalidad de autorrelato, planteamos una reconstrucción genealógica de la memoria larga de la experiencia en estos territorios que habilita a lecturas sobre el extractivismo. Para ello nos valemos de un diseño de tipo flexible y de un procedimiento intensivo que nos permite un ida y vuelta no lineal entre la complejidad del campo y la teorización. Como apuesta metodológica buscamos darles contenido político a las experiencias invisibilizadas, pensando la palabra como medio de transformación y terreno de disputa. Nos interesa aportar al conocimiento de los efectos de los regímenes extractivistas desde la producción y circulación de sentidos “otros”, construidos en las intersecciones -de género, clase, territorio- desde las cuales se vivencian y construyen oposiciones a la ofensiva extractivista. En el siguiente artículo, deseamos dirigirnos hacia la construcción de epistemologías para la aproximación analítica de las intervenciones y las acciones sociales del trabajo social desde parámetros socio-críticos y complejos, (...) a través de la consideración de las intervenciones sociales como culturas políticas. El fin de esta reflexión es favorecer vías de comprensión de la práctica de intervención de forma integral, en interdependencia con lo macro social, para lograr cumplir con la necesaria tarea de nutrir reflexivamente las dimensiones del trabajo social.: Social work as discipline is trapped between utopias and technologies integrated in devices of power and, we propose, could take more control of its own possibilities if it is self-observed as a system which produces and reproduces shared cultures and socio-political relations. In the following article, we focus on the construction of epistemologies for the analytical approximation of interventions and social actions of social work from socio-critical and complex parameters. We make this approach through the consideration of social interventions as political cultures. - Unveiling humour in digital discourse: the pragmatic functions of humorous stickers in Spanish WhatsApp chat groups.Esther Linares Bernabéu &MaríaBelén Alvarado Ortega -2025 -Lodz Papers in Pragmatics 21 (1):55-82.This paper presents an analysis of the use of humorous stickers within a WhatsApp chat group. With the rapid growth of digital communication, particularly on mobile devices, WhatsApp has become a popular platform for various forms of interaction, including voice and video calls, as well as text and voice messaging. In this context, humour is a prevalent phenomenon, especially in groups where participants have established familiarity and trust. The prevalence of humour in digital communication is largely attributed to the use (...) of multimodal resources, such as stickers – digital images that can include text and are used to convey emotions, feelings, and humour. The study’s initial hypothesis posits that stickers serve as a means of humour contextualization, helping to emphasize and enhance the intended humour in messages. Additionally, stickers are believed to aid in reducing misunderstandings during communication and mitigating potential threats to the participants’ social image. For this case study, the researchers employed a qualitative approach to analyse conversations within a Spanish WhatsApp group comprising numerous participants, resulting in a corpus comprising 44,362 words and 273 stickers. - El transfeminismo no es un humanismo: cruces entre animalidad y género.Anahí Gabriela González &MaríaBelén Ballardo -2024 -Astrolabio: Nueva Época 33:106-133.En el presente trabajo pretendemos argumentar que el transfeminismo no es un humanismo, es decir, no puede consistir en una ampliación del proyecto humanista que conserve intactas las estructuras de exclusión que distribuyen privilegios. Antes bien, el transfeminismo ha de ser un antiespecismo y el antiespecismo ha de ser un transfeminismo, si ambos movimientos pretenden potenciar sus luchas contra toda forma de opresión. El artículo se despliega en los siguientes momentos: en primer lugar, sostenemos que el feminismo antiespecista clásico reproduce (...) el régimen heterosexual y una perspectiva binaria del género. En segundo lugar, mostramos que las reflexiones de los ecofeminismos queer, la teoría queer y los estudios trans pueden contribuir a que el feminismo antiespecista aborde cómo el sistema de opresión cisheterosexual se articula con el régimen especista. En tercer lugar, reflexionamos sobre el problema del sujeto político del feminismo desde una perspectiva antiespecista y posthumana. The purpose of the analysis proposed in this document was to know the main characteristics of the publications registered in the Scopus and Wos databases and their scope in the study of the proposed variables, achieving the identification of 58 publications in (...) total. Thanks to this first identification, it was possible to refine the results through the keywords entered in the search button of both platforms, the following keywords: MANAGEMENT ACCOUNTING, INNOVATION, FINANCIAL MANAGEMENT, SUSTAINABILITY, reaching a total of 15 documents, excluding duplicates and those that did not meet the analysis criteria. From this analysis, it is expected to know the contributions of the scientific community to the study of the contributions of administrative accounting in sustainable financial management, in support of decision-making by senior management, always seeking the optimization of resources and increase profitability through innovation and the principles of sustainability. Las procesiones constituyeron un ejemplo de dichas intenciones que, en muchos casos, fueron aprovechadas por la Iglesia a fin de generar capital político. Muzio -2022 -Frontiers in Psychology 13:742810.BackgroundThis study analyzed the difference in psychological distress of the healthcare workers in three different periods of the coronavirus disease 2019 (COVID-19) pandemic in Argentina. Specifically, from the third week of the mandatory quarantine through the two following weeks.MethodsAnalysis of the responses of 1,458 members of the health personnel was done on a questionnaire on healthcare workers concerns regarding the care of patients with coronavirus, indicators of depression, anxiety, intolerance of uncertainty, and coping.ResultsThe psychological indicators that were considered presented differences (...) between the evaluated periods. Perceived concerns about the possibility of infecting loved ones and infecting themselves were greatest in the periods after the onset of the pandemic. In addition, the perception of how the work environment worsened and how lack of sleep interfered with their work was also higher in periods 2 and 3. The same results were found in the indicators of depression, anxiety, and intolerance of uncertainty. Finally, the indicators of high tension and concurrent lack of emotional control, which was greater in the last periods evaluated, were also expressed in the coping strategies (showing emotional lability, only contained by hypercontrol).ConclusionThe differences found in the psychological indicators between the evaluated periods support the need for early psychological care of health personnel which should be a priority of public health and a fundamental fact to increase its immediate effectiveness in the care of infected patients. Cortical reactivity measured with Transcranial Magnetic Stimulation combined with Electroencephalography is altered in pathological conditions, and it may also be a marker of cognitive status in middle-aged adults. In this study, we investigated the associations between cognitive measures and TMS evoked EEG reactivity and explored whether the effects of this relationship were related to neurofilament light chain levels, a marker of neuroaxonal damage.MethodsFifty two healthy middle-aged adults from (...) the Barcelona Brain Health Initiative cohort underwent TMS-EEG, a comprehensive neuropsychological assessment, and a blood test for NfL levels. Global and Local Mean-Field Power, two measures of cortical reactivity, were quantified after left prefrontal cortex stimulation, and cognition was set as the outcome of the regression analysis. The left inferior parietal lobe was used as a control stimulation condition.ResultsLocal reactivity was significantly associated with working memory and reasoning only after L-PFC stimulation. No associations were found between NfL and cognition. These specific associations were independent of the status of neuroaxonal damage indexed by the NfL biomarker and remained after adjusting for age, biological sex, and education.ConclusionOur results demonstrate that TMS evoked EEG reactivity at the L-PFC, but not the L-IPL, is related to the cognitive status of middle-aged individuals and independent of NfL levels, and may become a valuable biomarker of frontal lobe-associated cognitive function. - Psychological Symptoms in Health Professionals in Spain After the First Wave of the COVID-19 Pandemic.María Dosil,Naiara Ozamiz-Etxebarria,IratxeRedondo,Maitane Picaza &Joana Jaureguizar -2020 -Frontiers in Psychology 11.Following the declaration of the COVID-19 outbreak as a global pandemic in March 2020, a state of alarm was decreed in Spain. In this situation, healthcare workers experienced high levels of stress, anxiety and depression due to the heavy workload and working conditions. Although Spain experienced a progressive decline in the number of COVID-19 cases until the last week of May and the work overload among health workers was substantially reduced, several studies have shown that this work overload is associated (...) with the later emergence of psychological symptoms induced by stress. The aim of the present study was to evaluate the levels of stress, anxiety, depression, post-traumatic stress and compassionate fatigue in health professionals. The sample consisted of 973 health professionals 16.5% men, 82.9% women, and one non-binary person. The data were collected through an online questionnaire sent to the participants by e-mail. DASS-21 was used to measure anxiety, stress and depression, PCL-C to measure post-traumatic stress and ProQOL -vIV to measure compassion fatigue. In addition, other descriptive variables that could be related to these levels of psychological symptomatology were evaluated. The results reveal that after the work overload experienced during the COVID-19 pandemic, healthcare workers report psychological symptoms, post-traumatic stress and compassion fatigue. It is therefore recommended that these professionals be provided with psychological help in order to reduce the emotional impact of COVID-19, and consequently improve their mental health. (shrink)

The second part projects this analysis to the legal domain. The author stresses that universalism and particularism regarding reasons are mutually exclusive theories linked to incompatible conceptions of norms, i.e. norms as strict universal conditionals and norms as defeasible conditionals. In giving an account of this tenet, different meanings of universality and defeasibility are explored. A parallel debate regarding reasons can be found in the legal (...) domain, where two contrasting categories of norms are usually distinguished: rules and principles. On this issue the author argues that the conception of legal reasons depends on the way in which this contrast between different kinds of legal norms is shaped. (shrink)

En esta primera parte, además, el artículo se ocupa de algunas distinciones: entre normas y meta-normas, entre reglas legisladas y reglas consuetudinarias, y entre reglas constitutivas y reglas regulativas; todo ello con el objetivo de determinar a cuál de estas categorías pertenecen las reglas que definen la autoridad legislativa suprema de un orden jurídico. La conclusión es que las reglas (...) básicas que definen las autoridades legislativas supremas de cada orden jurídico existente, son necesariamente meta-normas constitutivas con naturaleza consuetudinaria. En la segunda parte de este artículo se toman en consideración los diferentes contenidos posibles de las reglas últimas que definen la autoridad legislativa. Sobre esta base, se distinguen cuatro modelos de sistema jurídico y autoridad legislativa: los que se corresponden con la autoridad absoluta y con la autoridad moral, y los que se corresponden con el estado de derecho y con el estado constitucional. En este sentido, se ofrecen algunas consideraciones: por un lado, para hacer referencia a la específica noción de autoridad que opera dentro del estado constitucional; y, por otro lado, para formular una puntual crítica a la distinción teórica entre autoridad constituyente y autoridad constituida. Según el análisis provisto en este artículo, cada autoridad es una autoridad constituida. Donaldson had been diagnosed with brain cancer, and he desired to die in order to cryonically preserve his brain, so as to stop its further deterioration. This case elicits an important question: is this a case of euthanasia? In this article, we examine the traditional criteria of death, and contrast it with the information-theoretic criterion. If this criterion is accepted, we posit that Donaldson’s case would (...) have been cryocide, but not euthanasia. We then examine if cryocide is an ethically feasible alternative to euthanasia.
