    Challenges of coverage policy development for next-generation tumor sequencing panels: Experts and payers weigh in.Julia R. Trosman,Christine B. Weldon,R.Kate Kelley &Kathryn A.Phillips -unknown
    © JNCCN-Journal of the National Comprehensive Cancer Network.Background: Next-generation tumor sequencing panels, which include multiple established and novel targets across cancers, are emerging in oncology practice, but lack formal positive coverage by US payers. Lack of coverage may impact access and adoption. This study identified challenges of NGTS coverage by private payers.Methods: We conducted semi-structured interviews with 14 NGTS experts on potential NGTS benefits, and with 10 major payers, representing more than 125,000,000 enrollees, on NGTS coverage considerations. We used the (...) framework approach of qualitative research for study design and thematic analyses and simple frequencies to further describe findings.Results: All interviewed payers see potential NGTS benefits, but all noted challenges to formal coverage: 80% state that inherent features of NGTS do not fit the medical necessity definition required for coverage, 70% view NGTS as a bundle of targets versus comprehensive tumor characterization and may evaluate each target individually, and 70% express skepticism regarding new evidence methods proposed for NGTS. Fifty percent of payers expressed sufficient concerns about NGTS adoption and implementation that will preclude their ability to issue positive coverage policies.Conclusions: Payers perceive that NGTS holds significant promise but, in its current form, poses disruptive challenges to coverage policy frameworks. Proactive multidisciplinary efforts to define the direction for NGTS development, evidence generation, and incorporation into coverage policy are necessary to realize its promise and provide patient access. This study contributes to current literature, as possibly the first study to directly interview US payers on NGTS coverage and reimbursement. (shrink)

    Art theory has consistently emphasised the importance of situational, cultural, institutional and historical factors in viewers’ experience of fine art. However, the link between this heavily context-dependent interpretation and the workings of the mind is often left unexamined. Drawing on relevance theory—a prominent, cogent and productive body of work in cognitive pragmatics—we here argue that fine art achieves its effects by prompting the use of cognitive processes that are more commonly employed in the interpretation of words and other stimuli presented (...) in a communicative context. We describe in particular how institutional factors effectively co-opt these processes for new ends, allowing viewers to achieve cognitive effects that they otherwise would not, and so provide cognitivist backing for an Institutional Theory of Art, such as that put forward by Arthur Danto. More generally, we situate and describe the Western fine art tradition as a phenomenon that is a consequence of both the cognitive processes involved in communication, and of cultural norms, practices and institutions.     This article seeks to explicate one form of technical rationality (ie the technological development of robotics) in social work education and practice. As advances in robotics evolve, questions are raised about the role of technicist education in reducing social work practice to a set of tasks that are repeatable, formulaic and linear (ie tasks that robots are capable of performing). We conduct a critical synthesis of the literature to explore how these parallel processes potentially create a seamless transition for social (...) robots to replace the human social work workforce. Our analysis suggests that social workers need to reclaim a broader understanding of social work education and practice if we intend to retain human social work practitioners into the future. We argue that this is vital because critical social work practitioners are more capable than robots of meeting the espoused social justice values of social work. (shrink)

    We describe work in progress to conduct a systematic review of research on effects of arts-based programs for mental health in young people. We are at the stage of searching for relevant studies through major databases and screening extant systematic reviews for additional research which meet our inclusion criteria. At this stage, however, concerns have arisen regarding both the quality of existing primary studies and of recently published systematic reviews in this area of arts and health. As a case in (...) point, in this paper we focus on one research report on art therapy with adolescent girls and its inclusion in three systematic reviews. We demonstrate that the reviews fail to undertake a robust critique of the Bazargan and Pakdaman paper and that the paper and reviews are flawed. Drawing on recent criticisms of systematic reviewing, we consider the value of proceeding with our systematic review as initially planned. (shrink)

    Leading philosopher of religion D. Z.Phillips argues that intellectuals need not see their task as being for or against religion, but as one of understanding it. What stands in the way of this task are certain methodological assumptions about what enquiry into religion must be. Beginning with Bernard Williams on Greek gods,Phillips goes on to examine these assumptions in the work of Hume, Feuerbach, Marx, Frazer, Tylor, Marett, Freud, Durkheim, Le;vy-Bruhl, Berger and Winch.     Reeder’s article offers a new and intriguing approach to the study of people’s ordinary understanding of freedom and constraint. On this approach, people use information about freedom and constraint as part of a quasi-scientific effort to make accurate inferences about an agent’s motives. Their beliefs about the agent’s motives then affect a wide variety of further psychological processes, including the process whereby they arrive at moral judgments. In illustrating this new approach, Reeder cites an elegant study he conducted a number (...) of years ago (Reeder & Spores, 1983). All subjects were given a vignette about a man who goes with his date to a pizza parlor and happens to come across a box that has been designated for charitable donations. In one condition, the man’s date then requests that he make a donation; in the other, she requests that he steal the money that is already in the box. In both conditions, the man chooses to comply with this request. The key question is how subjects will use his behavior to make inferences about whether he is a morally good or morally bad person. The results revealed a marked difference between conditions. When the man donated to charity, subjects were generally disinclined to conclude that he must have been a morally good person. It is as though they were thinking: ‘He didn’t just do this out of the goodness of his heart. (shrink)

    Photography and causation: Responding to Scruton's scepticism.Dawn M.Phillips -2009 -British Journal of Aesthetics 49 (4):327-340.
    According to Roger Scruton, it is not possible for photographs to be representational art. Most responses to Scruton’s scepticism are versions of the claim that Scruton disregards the extent to which intentionality features in photography; but these cannot force him to give up his notion of the ideal photograph. My approach is to argue that Scruton has misconstrued the role of causation in his discussion of photography. I claim that although Scruton insists that the ideal photograph is defined by its (...) ‘merely causal’ provenance, in fact he fails to take the causal provenance of photographs seriously enough. To replace Scruton’s notion of the ideal photograph, I offer a substantive account of the causal provenance of photographs, centred on the distinctive role of ‘the photographic event’. I conclude that, with a proper understanding of the photographic process, we have good reason to re-open the question of photography as a representational art. (shrink)

    Exploitation in payments to research subjects.TrishaPhillips -2011 -Bioethics 25 (4):209-219.
    Offering cash payments to research subjects is a common recruiting method but there is significant debate about whether and in what amount such payments are appropriate. This paper is concerned with exploitation and whether there should be a lower limit on the amount researchers can pay their subjects. When subjects participate in research as a way to make money, fairness requires that researchers pay them a fair wage. This call for the establishment of a lower limit meets resistance in two (...) places: (1) denial that the payments offered by researchers are wages for participation; and (2) concern about undue inducement. This paper critically examines these arguments for and against a lower limit. It shows that the need for a lower limit cannot be avoided by adopting a non-wage payment model and that concerns about undue inducement are unjustified in all trials except those that present greater than minimal risk. This analysis suggests the following compromise position: there should be an unconditional lower limit on payment amounts so that researchers cannot offer less than a fair wage, and when researchers cannot satisfy this limit because fairness requires a problematically large payment, then researchers should offer no payment at all.     Excavating AI: the politics of images in machine learning training sets.Kate Crawford &Trevor Paglen -forthcoming -AI and Society:1-12.
    By looking at the politics of classification within machine learning systems, this article demonstrates why the automated interpretation of images is an inherently social and political project. We begin by asking what work images do in computer vision systems, and what is meant by the claim that computers can “recognize” an image? Next, we look at the method for introducing images into computer systems and look at how taxonomies order the foundational concepts that will determine how a system interprets the (...) world. Then we turn to the question of labeling: how humans tell computers which words will relate to a given image. What is at stake in the way AI systems use these labels to classify humans, including by race, gender, emotions, ability, sexuality, and personality? Finally, we turn to the purposes that computer vision is meant to serve in our society—the judgments, choices, and consequences of providing computers with these capacities. Methodologically, we call this an archeology of datasets: studying the material layers of training images and labels, cataloguing the principles and values by which taxonomies are constructed, and analyzing how these taxonomies create the parameters of intelligibility for an AI system. By doing this, we can critically engage with the underlying politics and values of a system, and analyze which normative patterns of life are assumed, supported, and reproduced. (shrink)

    We are told by philosophers that photographs are a distinct category of image because the photographic process is mind-independent. Furthermore, that the experience of viewing a photograph has a special status, justified by a viewer’s knowledge that the photographic process is mind-independent. Versions of these ideas are central to discussions of photography in both the philosophy of art and epistemology and have far-reaching implications for science, forensics and documentary journalism. Mind-independence (sometimes ‘belief independence’) is a term employed to highlight what (...) is important in the idea that photographs can be produced naturally, mechanically, accidentally or automatically. Insofar as the process is physical, natural, mechanical or causal it can occur without human agency or intervention, entirely in the absence of intentional states. Presented innocuously, the idea is that although photographs are dependent on natural or mechanical processes, they can be produced independently of human agency – particularly human beliefs. Presented in a stronger form, the claim is that even if human agency is heavily involved in the production process, the definitive features that make the photograph a photograph and determine its salient properties are nonetheless independent of human minds. In epistemic debates, mind-independence is viewed as essential for explaining why photographs occupy a distinct category among images and justifying a variety of claims about their privileged epistemic and affective status in science, forensics, popular culture and journalism.     Internalism about reasons: sad but true?Kate Manne -2014 -Philosophical Studies 167 (1):89-117.
    Internalists about reasons following Bernard Williams claim that an agent’s normative reasons for action are constrained in some interesting way by her desires or motivations. In this paper, I offer a new argument for such a position—although one that resonates, I believe, with certain key elements of Williams’ original view. I initially draw on P.F. Strawson’s famous distinction between the interpersonal and the objective stances that we can take to other people, from the second-person point of view. I suggest that (...) we should accept Strawson’s contention that the activity of reasoning with someone about what she ought to do naturally belongs to the interpersonal mode of interaction. I also suggest that reasons for an agent to perform some action are considerations which would be apt to be cited in favor of that action, within an idealized version of this advisory social practice. I then go on to argue that one would take leave of the interpersonal stance towards someone—thus crossing the line, so to speak—in suggesting that she do something one knows she wouldn’t want to do, even following an exhaustive attempt to hash it out with her.     Where are human subjects in Big Data research? The emerging ethics divide.Kate Crawford &Jacob Metcalf -2016 -Big Data and Society 3 (1).
    There are growing discontinuities between the research practices of data science and established tools of research ethics regulation. Some of the core commitments of existing research ethics regulations, such as the distinction between research and practice, cannot be cleanly exported from biomedical research to data science research. Such discontinuities have led some data science practitioners and researchers to move toward rejecting ethics regulations outright. These shifts occur at the same time as a proposal for major revisions to the Common Rule—the (...) primary regulation governing human-subjects research in the USA—is under consideration for the first time in decades. We contextualize these revisions in long-running complaints about regulation of social science research and argue data science should be understood as continuous with social sciences in this regard. The proposed regulations are more flexible and scalable to the methods of non-biomedical research, yet problematically largely exclude data science methods from human-subjects regulation, particularly uses of public datasets. The ethical frameworks for Big Data research are highly contested and in flux, and the potential harms of data science research are unpredictable. We examine several contentious cases of research harms in data science, including the 2014 Facebook emotional contagion study and the 2016 use of geographical data techniques to identify the pseudonymous artist Banksy. To address disputes about application of human-subjects research ethics in data science, critical data studies should offer a historically nuanced theory of “data subjectivity” responsive to the epistemic methods, harms and benefits of data science and commerce.     Whistleblowing as a Protracted Process: A Study of UK Whistleblower Journeys.ArronPhillips &Wim Vandekerckhove -2019 -Journal of Business Ethics 159 (1):201-219.
    This paper provides an exploration of whistleblowing as a protracted process, using secondary data from 868 cases from a whistleblower advice line in the UK. Previous research on whistleblowing has mainly studied this phenomenon as a one-off decision by someone perceiving wrongdoing within an organisation to raise a concern or to remain silent. Earlier suggestions that whistleblowing is a process and that people find themselves inadvertently turned into whistleblowers by management responses, have not been followed up by a systematic study (...) tracking the path of how a concern is repeatedly raised by whistleblowers. This paper provides a quantitative exploration of whistleblowing as a protracted process, rather than a one-off decision. Our research finds that the whistleblowing process generally entails two or even three internal attempts to raise a concern before an external attempt is made, if it is made at all. We also find that it is necessary to distinguish further between different internal as well as external whistleblowing recipients. Our findings suggest that whistleblowing is a protracted process and that this process is internally more protracted than previously documented. The overall pattern is that whistleblowers tend to search for a more independent recipient at each successive attempt to raise their concern. Formal whistleblower power seems to determine which of the available recipients are perceived as viable and also what the initial responses are in terms of retaliation and effectiveness. (shrink)

    Revealed preference approaches to modelling agents’ choices face two seemingly devastating explanatory objections. The no self-explanation objection imputes a problematic explanatory circularity to revealed preference approaches, while the causal explanation objection argues that, all things equal, a scientific theory should provide causal explanations, but revealed preference approaches decidedly do not. Both objections assume a view of explanation, the constraint-based view, that the revealed preference theorist ought to reject.     An exploration of the theories, histories, practices, and contradictions of liberalism today. What does it mean to be a liberal in neoliberal times? This collection of short essays attempts to show how liberals and the wider concept of liberalism remain relevant in what many perceive to be a highly illiberal age. Liberalism in the broader sense revolves around tolerance, progress, humanitarianism, objectivity, reason, democracy, and human rights. Liberalism's emphasis on individual rights opened a theoretical pathway to neoliberalism, through private property, (...) a classically minimal liberal state, and the efficiency of “free markets.” In practice, neoliberalism is associated less with the economic deregulation championed by its advocates than the re-regulation of the economy to protect financial capital. Liberalism in Neoliberal Times engages with the theories, histories, practices, and contradictions of liberalism, viewing it in relation to four central areas of public life: human rights, ethnicity and gender, education, and the media.     Philosophers have turned their attention to gaslighting only recently, and have made considerable progress in analysing its characteristic aims and harms. I am less convinced, however, that we have fully understood its nature. I will argue in this paper that philosophers and others interested in the phenomenon have largely overlooked a phenomenon I call moral gaslighting, in which someone is made to feel morally defective—for example, cruelly unforgiving or overly suspicious—for harbouring some mental state to which she is entitled. If (...) I am right about this possibility, and that it deserves to be called gaslighting, then gaslighting is a far more prevalent and everyday phenomenon than has previously been credited. And it can also be a purely structural phenomenon, as well as an interpersonal one, which remains a controversial possibility in the current literature. (shrink)

    Centralised, compliance-focused approaches to research ethics have been normalised in practice. In this paper, we argue that the dominance of such systems has been driven by neoliberal approaches to governance, where the focus on controlling and individualising risk has led to an overemphasis of decontextualised ethical principles and the conflation of ethical requirements with the documentation of ‘informed consent’. Using a UK-based case study, involving a point-of-care-genetic test as an illustration, we argue that rather than ensuring ethical practice such compliance-focused (...) approaches may obstruct valuable research. We call for an approach that encourages researchers and research communities—including regulators, ethics committees, funders and publishers of academic research—to acquire skills to make morally appropriate decisions, and not base decision-making solely on compliance with prescriptive regulations. We call this ‘ethical preparedness’ and outline how a research ethics system might make space for this approach. (shrink)

    As audiences demand better and more diverse representation in the fictions they consume, there is a question of how that demand should be placed on fiction creators. In this article, I answer this question by arguing creators of fiction have a hermeneutical responsibility to include diverse characters in their creations, and to do so without relying on harmful stereotypes. I cast this responsibility as the epistemic virtue of due diligence, offset by epistemic laziness and epistemic paralysis as the corresponding vices (...) of absence and excess, respectively. Practicing either vice can constitute a type of hermeneutical gap described by Katharine Jenkins, in which harmful stereotypes (conceptions) become more accessible to epistemic agents than the more accurate concept. By blocking the agent's access to the accurate conception, such stereotypes create a hermeneutical gap and can contribute to hermeneutical injustices, as described by Miranda Fricker and José Medina. Many of us owe our existence and our continued vigour to some achievement of medical technology. And what is true in a major way of general medicine is to a significant degree true of psychiatry. Prozac has long since arrived, and in its wake an ever-growing armamentarium of new psychotropics; beyond that, (...) neuroscience promises ever more technological advances for the field. -/- However, the effect of technology on the field of psychiatry remains highly ambiguous. On the one hand there are the achievements, both in the science and practice of psychiatry; on the other hand technology's influence on the field threatens its identity as a humanistic practice. In this ambiguity psychiatry is not unique - major thinkers have for a long time been highly ambivalent and concerned about the technological order that now defines modern society. For the future, the danger is that the psychiatrically real becomes that which can be seen, the symptom, and especially that which can be measured. Disorders and treatments might become reduced to what can be defined by diagnostic criteria and what can be mapped out on a scale. -/- This book exams how technology has come to influence and drive psychiatry forward, and considers at just what cost these developments have been made.     Can an Algorithm be Agonistic? Ten Scenes from Life in Calculated Publics.Kate Crawford -2016 -Science, Technology, and Human Values 41 (1):77-92.
    This paper explores how political theory may help us map algorithmic logics against different visions of the political. Drawing on Chantal Mouffe’s theories of agonistic pluralism, this paper depicts algorithms in public life in ten distinct scenes, in order to ask the question, what kinds of politics do they instantiate? Algorithms are working within highly contested online spaces of public discourse, such as YouTube and Facebook, where incompatible perspectives coexist. Yet algorithms are designed to produce clear “winners” from information contests, (...) often with little visibility or accountability for how those contests are designed. In isolation, many of these algorithms seem the opposite of agonistic: much of the complexity of search, ranking, and recommendation algorithms is nonnegotiable and kept far from view, inside an algorithmic “black box.” But what if we widen our perspective? This paper suggests agonistic pluralism as both a design ideal for engineers and a provocation to understand algorithms in a broader social context: rather than focusing on the calculations in isolation, we need to account for the spaces of contestation where they operate.     A new emphasis on diversity and difference is displacing older myths of nation or community. A new attention to gender, race, language or religion is disrupting earlier preoccupations with class. But the welcome extended to heterogeneity can bring with it a disturbing fragmentation and closure. Can we develop a vision of democracy through difference: a politics that neither denies group identities nor capitulates to them? In this volume, AnnePhillips develops the feminist challenge to exclusionary versions of democracy, citizenship (...) and equality. Relating this to the crisis in socialist theory, the growing unease with the pretensions of Enlightenment rationality, and the recent recuperation of liberal democracy as the only viable politics, she builds on debates within feminism to address general questions of difference. When democracies try to wish away group difference and inequality, they fail to meet their egalitarian promise. When yearnings towards an undifferentiated unity become the basis for radical politics and change, too many groups drop out of the picture. Through her critical discussions of recent feminist and socialist theory AnnePhillips rejects this democracy of denial. She also warns, however, of the dangers on the other side. The simpler celebrations of diversity risk freezing group differences as they are, encouraging a patchwork of local identities from which people can speak only to themselves. Her arguments then combine in a powerful restatement of the case for a more active and participatory democracy. It is only through enhanced communication and discussion that people can respect and learn from their differences. (shrink)

If people recognized their common humanity, they would have a hard time mistreating other human beings. However, in some cases of gene-environment covariance, causal intuitions about the sources of trait difference can vary, leading experts to disagree as to how the heritability estimate should be interpreted.     Ethics guidelines and commentary suggest that a central function of research ethics committees is to assess the scientific merit of the protocols they review. However, some commentators object to this role, and evidence suggests that the assessment of scientific merit is a significant source of confusion and animosity between ethics committees and clinical investigators. In this essay, we argue that ethics committees should assess the scientific value and validity of research protocols and that new decision-making tools are needed to help (...) them do so in a systematic, transparent, and reliable way.
