Impact of the life-sustaining treatment decision act on organ donation in out-of-hospital cardiac arrests in South Korea: a multi-centre retrospective study.Min Jae Kim,Dong Eun Lee,Jong Kun Kim,In Hwan Yeo,Haewon Jung,Jung Ho Kim,Tae Chang Jang,Sang-Hun Lee,Jinwook Park,Deokhyeon Kim &Hyun Wook Ryoo -2024 -BMC Medical Ethics 25 (1):1-9.
The demand for organ transplants, both globally and in South Korea, substantially exceeds the supply, a situation that might have been aggravated by the enactment of the Life-Sustaining Treatment Decision Act (LSTDA) in February 2018. This legislation may influence emergency medical procedures and the availability of organs from brain-dead donors. This study aimed to assess LSTDA’s impact, introduced in February 2018, on organ donation status in out-of-hospital cardiac arrest (OHCA) patients in a metropolitan city and identified related factors. We conducted (...) a retrospective analysis of a regional cardiac arrest registry. This study included patients aged 16 or older with cardiac arrest and a cerebral performance category (CPC) score of 5 from January 2015 to December 2022. The exclusion criteria were CPC scores of 1–4, patients under 16 years, and patients declared dead or transferred from emergency departments. Logistic regression analysis was used to analyse factors affecting organ donation. Of the 751 patients included in this study, 47 were organ donors, with a median age of 47 years. Before the LSTDA, there were 30 organ donations, which declined to 17 after its implementation. In the organ donation group, the causes of cardiac arrest included medical (34%), hanging (46.8%), and trauma (19.2%). The adjusted odds ratio for organ donation before the LSTDA implementation was 6.12 (95% CI 3.09–12.12), with non-medical aetiology as associated factors. The enactment of the LSTDA in 2018 in South Korea may be linked to reduced organ donations among patients with OHCA, underscoring the need to re-evaluate the medical and legal aspects of organ donation, especially considering end-of-life care decisions. The duality of non-conceptual content in Husserl’s phenomenology of perception.Michael K.Shim -2005 -Phenomenology and the Cognitive Sciences 4 (2):209-229.
Recently, a number of epistemologists have argued that there are no non-conceptual elements in representational content. On their view, the only sort of non-conceptual elements are components of sub-personal organic hardware that, because they enjoy no veridical role, must be construed epistemologically irrelevant. By reviewing a 35-year-old debate initiated by Dagfinn F.

(1 other version)Literary Racial Impersonation.JoyShim -2021 -Ergo: An Open Access Journal of Philosophy 8.
Literary racial impersonation occurs when a narrative work fails to express the perspective of a minority ethnic or racial group. Interestingly, even when these works express moral themes congenial to promoting empathetic responses towards these groups, they can be met with public outrage if the group’s perspective is portrayed inaccurately. My goal in this paper is to vindicate the intuition that failure to express the perspective of a minority group well renders the work defective, both aesthetically and morally. I argue (...) that available frameworks exploring the connections between aesthetic and moral realms of value are inadequate to analyzing this phenomenon and propose a novel connection between aesthetic and moral values. Specifically, I demonstrate that the primary defect of literary racial impersonation is aesthetic and contingently constitutes a moral defect in our current social context. (shrink)

    Representationalism and Husserlian Phenomenology.Michael K.Shim -2011 -Husserl Studies 27 (3):197-215.
According to contemporary representationalism, phenomenal qualia—of specifically sensory experiences—supervene on representational content. Most arguments for representationalism share a common, phenomenological premise: the so-called “transparency thesis.” According to the transparency thesis, it is difficult—if not impossible—to distinguish the quality or character of experiencing an object from the perceived properties of that object. In this paper, I show that Husserl would react negatively to the transparency thesis; and, consequently, that Husserl would be opposed to at least two versions of contemporary representationalism. First, (...) I show that Husserl would be opposed to strong representationalism, since he believes the cognitive content of a perceptual episode can vary despite constancy of sensory qualia. Second, I then show that Husserl would be opposed to weak representationalism, since he believes that sensory qualia—specifically, the sort that he calls “kinesthetic sensations”—can vary despite constancy in representational content. Consumers’ ethical orientation and pro-firm behavioral response to CSR.KyuJinShim &Soojin Kim -2019 -Asian Journal of Business Ethics 8 (2):127-154.
This study identifies the roles of consumers’ ethical orientations and CSR motives and the dynamics of these two variables on the subsequent consumers’ attitudinal and behavioral responses to CSR—perceived corporate authenticity and pro-firm behavioral intentions. To examine the impact of individual consumers’ ethical orientations, the authors measured consumers’ ethical orientations such as deontology and consequentialism through a Web-based survey conducted in Korea and in the USA. Further, to investigate the role of perceived CSR motives, the authors measured the perception of (...) a company’s business-oriented motives and society-oriented motives in conducting CSR. Results demonstrate the different role of ethical orientation in impacting consumers’ responses across these countries. Consumers’ consequentialist orientation appears to be positively associated with pro-firm behavioral intention in both the Korean and the US studies. In the Korean study, Consumers’ deontological orientation reduces perceived corporate authenticity when corporate motives seem business-oriented. Theoretical and practical implications are discussed. The structure of silence in depression.Jae Ryeong Sul -2025 -Synthese 205 (2):1-23.
Silence has been a relatively neglected phenomenon despite its significance in psychiatric research. Acknowledging this oversight, there has been a recent move towards systematically describing the first-personal experience of silence in mental disorders within the field of philosophy of psychiatry. This paper contributes to this research effort by highlighting the underexplored interpersonal aspect of silence crucial for both psychopathological and therapeutic research. More specifically, I develop the interpersonal aspect of distressing silence associated with depression, recently coined as ‘empty silence’. Complementing (...) its original analysis, I argue that this distressing silence not only involves the loss of linguistic agency but also the loss of social agency. Having established this claim, I situate it within the wider research context and open an ethical dimension to the current analysis. I explore this by identifying a therapeutic silence others can establish for an individual undergoing a severe depressive episode. I provisionally term it ‘undemanding silence’ and argue that this form of silence can help restore the loss of social agency by providing a distinct form of social affordance that depressed individuals can easily realise at their own pace. Review: Nuzzo, Ideal embodiment: Kant's theory of sensibility.Michael K.Shim -2010 -Journal of the History of Philosophy 48 (2):pp. 248-249.
This book is a survey of Kant's three Critiques that makes use of an "interpretive concept" that Nuzzo calls "transcendental embodiment" . According to Nuzzo, if we think of Kant as holding that there is something like the " a priori of the human body" or body as "the transcendental site of sensibility," which "displays a formal, ideal dimension essential to our experience as human beings" , then our understanding of Kant will be greatly improved. That is because the "notion (...) of transcendental embodiment provides the unifying thread of Kant's epistemology, moral philosophy, aesthetics and teleology of living nature" .The main body of the book is divided into three parts, each corresponding to one of the three Critiques. In turn, each part is divided into three chapters. For some grip on what Nuzzo means by "transcendental embodiment," the first chapter of the first part is the most helpful. What is behind this "interpretive concept" is Kant's argument against Leibnizian nominalism about space from "incongruent counterparts." Kant's argument is that there can be two. (shrink)

Ethics and Imagination.JoyShim &Shen-yi Liao -2023 - In James Harold,The Oxford handbook of Ethics and Art. New York, NY: Oxford University Press. pp. 709-727.
In this chapter, we identify and present predominant debates at the intersection of ethics and imagination. We begin by examining issues on whether our imagination can be constrained by ethical considerations, such as the moral evaluation of imagination, the potential for morality’s constraining our imaginative abilities, and the possibility of moral norms’ governing our imaginings. Then, we present accounts that posit imagination’s integral role in cultivating ethical lives, both through engagements with narrative artworks and in reality. Our final topic of (...) consideration focuses on the possibility of imagination constituting or constructing new ethical or political frameworks. (shrink)

Reimagining Profits and Stakeholder Capital to Address Tensions Among Stakeholders.Jae Hwan Lee,J. Robert Mitchell,Ronald K. Mitchell &David Hatherly -2020 -Business and Society 59 (2):322-350.
In this article, we use ideas from stakeholder capital maintenance theory to address tensions in allocating firm profits between stockholders and other stakeholders. We utilize a mediative thought experiment to conceptualize how multiple stakeholder interests might better be served, such that genuine firm profits (from new value creation) versus artificial firm profits (from non-wealth-producing transfers) may be identified and incentivized. We thereby examine how such accounting transfers can be envisioned as stakeholder capital to be maintained for the benefit of both (...) the firm and the economy. We present examples to illustrate the hypothetical model proposed and its implications. (shrink)

(4 other versions)Rethinking Human and Machine Intelligence under Determinism.Jae Jeong Lee -forthcoming -Prometeica - Revista De Filosofía Y Ciencias.
This paper proposes a metaphysical framework for distinguishing between human and machine intelligence. It posits two identical deterministic worlds -- one comprising a human agent and the other a machine agent. These agents exhibit different information processing mechanisms despite their apparent sameness in a causal sense. Providing a conceptual modeling of their difference, this paper resolves what it calls “the vantage point problem” – namely, how to justify an omniscient perspective through which a determinist asserts determinism from within the supposedly (...) deterministic universe. Constructing ‘others’ and a wider ‘we’ as emotional processes: A case of South Korea in times of crisis.Jae-Eun Noh -2022 -Thesis Eleven 170 (1):43-57.
This article examines how growing fears, insecurities and uncertainties during the COVID-19 pandemic have prompted an emotional distance from others. The aim is to explore how global solidarity and nationalism are challenged and constructed as collective emotional processes concerning ‘others’. Drawing on social theories of emotions during crises and emotions towards others, this study looks at policy decisions around vaccines and health services and their associated emotions in the context of Korea, which has a relatively small migrant population and a (...) short history of supporting people in lower-income countries. The study finds that the COVID-19 pandemic has strengthened nationalism, both ethnic nationalism and cosmopolitan nationalism. This points to the need to highlight global norms such as human rights and justice and cultivate foundational emotions such as empathy and compassion. This article suggests paying attention to the role of emotions in generating othering practices and developing global solidarity. (shrink)

Schizophrenia, Temporality, and Affection.Jae Ryeong Sul -2022 -Phenomenology and the Cognitive Sciences 21 (4):927-947.
Temporal experience and its radical alteration in schizophrenia have been one of the central objects of investigation in phenomenological psychopathology. Various phenomenologically oriented researchers have argued that the change in the mode of temporal experience present in schizophrenia can foreground its psychotic symptoms of delusion. This paper aims to further the development of such a phenomenological investigation by highlighting a much-neglected aspect of schizophrenic temporal experience, i.e., its non-emotional affective characteristic. In this paper, it denotes the type of an experience (...) wherein an afflicted individual experiences a pervasive pull or attraction coming from the past, present, and future. By employing Husserl’s account of affection, I argue that such an affectively prominent temporal experience is not yet another abnormality that happens to be present in schizophrenia. Instead, it is indicative of the core disturbance that underpins the schizophrenic temporal mode of experience. I identify such a disturbance as ‘affective modification dysfunction’ and employ it as a core concept with which I synthesize and organise heterogeneous components of schizophrenic temporal experience in their conceptual unity. For the sake of clear description, I organise those components into the following categories: 1.) Time Stop 2.) Ante-festum 3.) Déjà vu/vécu and 4.) Time Fragmentation. I conclude by demonstrating how approaching schizophrenic temporal experience from its affective dimension can further help us better understand its pre-psychotic phase known to precipitate schizophrenic primary delusion, i.e., delusional mood. The informational stance: Philosophy and logic. Part I. The basic theories.Wu Kun &Joseph E. Brenner -2013 -Logic and Logical Philosophy 22 (4):453-493.
To better understand what information is and to explain information-related issues has become an essential philosophical task. General concepts from science, ethics and sociology are insufficient. As noted by Floridi, a new philosophy, a Philosophy of Information (PI), is needed. In the 80’s, Wu Kun proposed a “The Basic Theory of the Philosophy of Information”, which became available in English only in 2010. Wu and Joseph Brenner then found that the latter’s non-standard “Logic in Reality” provided critical logical support for (...) Wu’s theory. In Part I of our paper, we outline the two basic theories as a metaphilosophy and metalogic for information. We offer our two theories as a further contribution to an informational paradigm. In Part II [WuB14], we develop the relation between information and social value as a basis for the ethical development of the emerging Information Society. (shrink)

Merleau-Ponty’s Embodied Phenomenology and the Multiplicity of Trans Narratives.
The Paradox of Subjectivity.Michael K.Shim -2005 -Husserl Studies 21 (2):139-144.
In this elegant, smoothly written book, David Carr provides nothing less than a defense of both Kantian and Husserlian versions of transcendental philosophy against Heidegger’s critique of metaphysics. Carr’s Paradox of Subjectivity is organized into four parts. In the first part, Carr provides a synopsis of Heidegger’s interpretation of traditional metaphysics. Part two is devoted to a reconstruction of Kant’s transcendental theory of subjectivity. The third part deals with Husserl’s conception of transcendental subjectivity. Finally, in part four, Carr proposes to (...) show that, for both Kant and Husserl, transcendental subjectivity is a purely methodological implement, which cannot in turn be reified into serving the role traditionally reserved for metaphysical substance. Instead, transcendental subjectivity is to be understood as itself a critical regard of traditional metaphysics. Moreover, such a strictly methodological conception of transcendental subjectivity cannot be assimilated into Heidegger’s conception of metaphysics. Consequently, Heidegger’s critique of metaphysics cannot be extended as a critique of either Kant or Husserl. (shrink)

Towards a Phenomenological Monadology. On Husserl and Mahnke.Michael K.Shim -2002 - In David Carr & Christian Lotz,Subjektivität, Verantwortung, Wahrheit: neue Aspekte der Phänomenologie Edmund Husserls. Frankfurt am Main: P. Lang. pp. 243-260.
The following proposes an interpretation of Husserl's sustained exegetical commentary on Leibniz's metaphysics from 1922 (Hua XIV 298300), with reference to textual and historical resources. The leading historical index for the following interpretation is a minor contribution to Leibniz scholarship from 1917 by Dietrich Mahnke, a work with which Husserl was intimately familiar. Textual references are to works by Husserl which would have been available to Mahnke- i.e., the Logische Untersuchungen and Ideen—I as well as relevant notes and lectures from (...) the period ni question. Husserl's brief manuscript from 1922, I claim, can be read as a critique of the Mahnke interpretation that attempts to provide a more expansive and thorough-going phenomenological explication of Leibniz' doctrine of universal harmony. Thereby, Husserl offers some important clues as to how he himself understands his own uses of the terms "monad" and "monadology." The phenomenological reformation of Leibnizian Monadology must be understood as a methodological reconception with internal reference to Husserl's own theory of intersubjectivity. (shrink)

    The Impact of Moral Emotions on Cause-Related Marketing Campaigns: A Cross-Cultural Examination.Jae-Eun Kim &Kim K. P. Johnson -2013 -Journal of Business Ethics 112 (1):79-90.
This research was focused on investigating why some consumers might support cause-related marketing campaigns for reasons other than personal benefit by examining the influence of moral emotions and cultural orientation. The authors investigated the extent to which moral emotions operate differently across a cultural variable (US versus Korea) and an individual difference variable (self-construal). A survey method was utilised. Data were collected from a convenience sample of US ( n = 180) and Korean ( n = 191) undergraduates. Moral emotions (...) significantly influenced purchase intention for a social-cause product. The influence of an ego-focused moral emotion (i.e., pride) on purchase intention was greater for US than Korean participants. The influence of another-focused moral emotion (i.e., guilt) on purchase intention was greater for high-interdependent participants than for low-interdependent participants. The findings of this research provide important and relevant implications to marketers and policy makers in developing persuasive messages and customer relationship programmes. (shrink)

    Leibniz on Concept and Substance.Michael K.Shim -2006 -International Philosophical Quarterly 46 (3):309-325.
A historically persistent way of reading Leibniz regards him as some kind of conceptualist. According to this interpretation, Leibniz was either an ontological conceptualist or an epistemological conceptualist. As an ontological conceptualist, Leibniz is taken to hold the view that there exist only concepts. As an epistemological conceptualist, he is seen as believing that we think only with concepts. I argue against both conceptualist renditions. I confront the ontological conceptualist view with Leibniz’s metaphysics of creation. If the ontological conceptualist interpretation (...) were right, then Leibniz could not invoke compossibility as a criterion of creation. But since he does invoke compossibility as a criterion of creation, the ontological conceptualist approach cannot be right. I confront the epistemological conceptualist interpretation with Leibniz’s assertion of non-conceptual content. Since Leibniz acknowledges non-conceptual content at least when it comes to metaphysical knowledge, Leibniz could not have been an epistemological conceptualist either. So, Leibniz could not have been a conceptualist at all. (shrink)

In this paper, I show that by “Monade” the later Husserl means roughly what he meant by “das reine Bewußtsein” in the period of Ideas I. Of both consciousness and Monade, Husserl claims that objects of perception are immanent to them. I describe this claim as “quasi-representationalist” just because it bears enough similarity to some versions of contemporary representationalism. Since Husserl also claims that perceptual objects are publicly accessible, the inevitable conclusion seems to be that parts of perceptual consciousness must (...) also be publicly accessible. So strong internalist, Cartesian or idealist, interpretations of Husserl must be wrong. By the same token, if perceptual objects are necessarily physical, it then seems Husserl must agree that the physical can be, in some sense, immanent to consciousness. (shrink)

Transference, Counter-transference, and Reflexivity in Intercultural Education.Jenna MinShim -2015 -Educational Philosophy and Theory 47 (7):675-687.
The article addresses the contributions psychoanalytic theory, particularly its concepts of transference and counter-transference, can make to our understanding of reflexivity in intercultural education (IE). After the introduction, the article is organized into three parts. The first part is a psychoanalytic discussion that focuses on the concepts of transference and counter-transference. The second part elaborates on the concepts of transference and counter-transference by presenting examples through existing studies in the fields of multicultural and IE and psychoanalysis to illuminate what it (...) would mean to psychoanalytically understand aspects of intercultural relations and reflexivity. In the third section, while contending that this article does not exclude other forms of reflexivity or delimit the danger of uncritically accepting the potentials for reflexivity, it offers the implications drawn from the discussions in the first and second sections by concluding that psychoanalysis is an area of inquiry that forces us to question how unconscious forces affect our interaction with students, the curriculum, and the meaning we give to teaching and learning experiences. The article concludes that reflexivity in IE can benefit from considering the effects of transference and counter-transference. (shrink)

Affective and Normative Motives to Work Overtime in Asian Organizations: Four Cultural Orientations from Confucian Ethics.Jae Hyeung Kang,James G. Matusik &Lizabeth A. Barclay -2017 -Journal of Business Ethics 140 (1):115-130.
Asian workplaces are often characterized by cultures that require more overtime than other cultures. Although predictors for overtime work have been rigorously studied, it is still meaningful to investigate specific aspects of Eastern cultural values that stem from Confucian ethics and may influence overtime work among Asian employees. We suggest that four major Confucian orientations are positively associated with employees’ affective and normative motives, which in turn affect working overtime. This article extends management literature on the subjects of cultural ethics (...) and workaholism. It also suggests how Eastern cultural values lead to working overtime. We hope that our research effort on Confucian cultural value and its associations with other managerial outcomes and theories is a small cornerstone that allows management researchers to explore interesting and meaningful ways to apply Confucian culture and orientations in the workplace. Host Country Sourcing of Multinational Enterprises: A Corporate Social Responsibility Perspective.Jae C. Jung &Khan-Pyo Lee -2018 -Journal of Business Ethics 152 (3):683-701.
Through corporate social responsibility activities, a firm can develop the capability for managing and benefiting from stakeholder relationships. This study refers to such a capability as stakeholder influence capacity. In a host country, locally sourcing parts and/or materials can generate economic value and improve social welfare. Moreover, local sourcing provides opportunities for a foreign firm to apply and advance SIC while closely interacting with host-country stakeholders. Accordingly, we expect that a firm, having gained SIC through CSR activities in its home (...) country, will be more likely to source parts and/or materials in the host country. We also expect that the relationship between SIC and host-country sourcing is conditional upon a foreign firm’s intangible resources and liabilities of foreignness. Our empirical analysis, using Korean datasets, supports the positive relationship between CSR and local sourcing. We find that this positive relationship is more pronounced either when the firm is committed to technology development or when its home and host countries are geographically or culturally distant. Ethical Perceptions of Business Students: Differences Between East Asia and the USA and Among “Confucian” Cultures.Kun Young Chung,John W. Eichenseher &Teruso Taniguchi -2008 -Journal of Business Ethics 79 (1-2):121-132.
This paper reports the results of a survey of 842 undergraduate business students in four nations - the United States of America, the Peoples' Republic of China, Japan, and the Republic of Korea. This survey asked students to respond to four scenarios with potentially unethical business behavior and a string of questions related to the importance of ethics in business strategy and in personal behaviors. Based on arguments related to differences in recent historical experiences, the authors suggest that student responses (...) may be as different within the East Asian environment as they are between this environment as a whole and the USA. Survey results indicate a greater perception of ethical problems and more importance placed on ethics per se in business practices, as well as less of an emphasis on social harmony on the part of USA students. At the same time, substantial national differences in response are also witnessed within the set of East Asian students. A priori expectations as to the manner in which these East Asian responses should vary based on differences in recent historical experiences are partially, but not fully, supported. The authors argue that the key value of the reported research rests on a demonstration that national differences within a common cultural area can be as great as differences across cultural areas and that practitioners of global business must fine-tune their expectations as to acceptable business and personal actions to accommodate specific national historical experiences to be effective. The Anticipatory Politics of Improving Childhood Survival for Sickle Cell Disease.Gina Jae -2018 -Science, Technology, and Human Values 43 (6):1122-1141.
Crediting scientific discovery for prolonging life is pervasive in biomedical histories of the genetic blood disorder, sickle cell disease. This includes the preventive strategies, such as newborn screening, that have underwritten the success of its life-extending interventions. Newborn screening is a technology that relies not only upon intact health infrastructures but also expertise and enhanced vigilance on the part of caregivers to anticipate complications while they are still open to circumvention. This paper posits that even after overcoming institutional barriers to (...) make newborn screening equitably available, care and vigilance are resources that are themselves subject to what I term anticipatory politics, where structural conditions also stratify expectations for the future, including the affective appeal of medical innovations. This paper elaborates the paradigm of anticipatory politics through an ethnographic examination of newborn screening to connect the comprehensive care practices that have improved survival for sickle cell disease, and as the burden of mortality shifts to young adulthood, to expose how those who are resourced to care for these futures preferentially stand to benefit from preventive interventions. Quantum Mechanics Emerges from Information Theory Applied to Causal Horizons.Jae-Weon Lee -2011 -Foundations of Physics 41 (4):744-753.
It is suggested that quantum mechanics is not fundamental but emerges from classical information theory applied to causal horizons. The path integral quantization and quantum randomness can be derived by considering information loss of fields or particles crossing Rindler horizons for accelerating observers. This implies that information is one of the fundamental roots of all physical phenomena. The connection between this theory and Verlinde’s entropic gravity theory is also investigated.
