    This paper analyses whether current explainable AI (XAI) techniques can help to address taxpayer concerns about the use of AI in taxation. As tax authorities around the world increase their use of AI-based techniques, taxpayers are increasingly at a loss about whether and how the ensuing decisions follow the procedures required by law and respect their substantive rights. The use of XAI has been proposed as a response to this issue, but it is still an open question whether current XAI (...) techniques are enough to meet existing legal requirements. The paper approaches this question in the context of a case study: a prototype tax fraud detector trained on an anonymized dataset of real-world cases handled by the Buenos Aires (Argentina) tax authority. The decisions produced by this detector are explained through the use of various classification methods, and the outputs of these explanation models are evaluated on their explanatory power and on their compliance with the legal obligation that tax authorities provide the rationale behind their decision-making. We conclude the paper by suggesting technical and legal approaches for designing explanation mechanisms that meet the needs of legal explanation in the tax domain. (shrink)

    RESUMEN La interpretación principal de la obra de Levinas sostiene que es una filosofía de la Responsabilidad por el Otro y que en esa Responsabilidad Ética acontece la subjetivación del sujeto en cuanto ruptura con el ser. En este sentido, el artículo mostrará una responsabilidad egoísta implicada en la filosofía juvenil de Levinas, afirmando con ello la posibilidad de pensar el fundamento donde la Responsabilidad Ética es posible. En otras palabras, se rescata la importancia de la materialidad dentro de la (...) empresa de evasión o salida radical del ser que Levinas desarrollará a lo largo de su obra. ABSTRACT The main interpretation of Levinas's work affirms that it is a philosophy of the Responsibility for the Other and that in this Ethical Responsibility occurs the subjectivation of the subject as a rupture with Being. In this sense, the aim of this article is to show that there is a selfish responsibility implied in the young Levinas, thus affirming the possibility of thinking about the ground where Ethical Responsibility is possible. In other words, the importance of the materiality within the philosophical project of the escape or the radical departure of Being that Levinas will develop throughout his work is rescued. (shrink)

    Social identity poses one of the most important challenges to rational choice theory, but rational choice theorists do not hold a common position regarding identity. On one hand, externalist rational choice ignores the concept of identity or reduces it to revealed preferences. On the other hand, internalist rational choice considers identity as a key concept in explaining social action because it permits expressive motivations to be included in the models. However, internalist theorists tend to reduce identity to desire—the desire of (...) a person to express his or her social being. From an internalist point of view, that is, from a viewpoint in which not only desires but also beliefs play a key role in social explanations as mental entities, this article rejects externalist reductionism and proposes a redefinition of social identity as a net of beliefs about oneself, beliefs that are indexical, robust, and socially shaped.     Is Natural Selection in Trouble? When Emotions Run High in a Philosophical Debate.Fernando Leal -2022 -Argumentation 36 (4):541-567.
    This paper deals in detail with a fairly recent philosophical debate centered around the ability of the theory of natural selection to account for those phenotypical changes which can be argued to make organisms better adapted to their environments. The philosopher and cognitive scientist Jerry Fodor started the debate by claiming that natural selection cannot do the job. He follows two main lines of argumentation. One is based on an alleged conceptual defect in the theory, the other on alleged empirical (...) problems in it as well as empirical alternatives to it. Four philosophers and two biologists respond in a way that displays what might easily be described as fallacious. The paper relies on the ideal model of critical discussion of pragma-dialectics to offer a step-by-step analysis of the whole debate, which extended for four issues of the _London Review of Books_, from October 2007 through January 2008. This pragma-dialectical analysis is carried out by constant reference to the various questions (problems, issues) that arise in the debate. The analysis includes as much detail as possible both in Fodor’s original argument and in the critics’ various comments as well as Fodor’s replies along two rounds of debate. Since a simple negative evaluation in terms of fallacies is out of the question in view of the proved argumentative accomplishments of the participants, an alternative explanation is offered: the undeniable derailments in strategic maneuvering are due to the fact that, whilst ostensibly discussing the theory of natural selection, Fodor’s detractors are worried by an underlying issue, namely, the dangers of discussing the merits and demerits of natural selection as a theory of evolution in a venue as exposed to the general public as the _London Review of Books_, given the religiously inspired movements that threaten the teaching of evolutionary biology in schools.     The article discusses the rights of minorities in the system of the International Covenant on Civil and Political Rights. It establishes a conceptual distinction between universal rights, specific rights of minorities in general and specific rights of particular minorities. Universal rights correspond to all individuals (e,g,, “no one shall be subjected to torture”) or all groups of a certain class (e.g., “all families are entitled to protection”). Minority groups and their members are entitled to these rights in the same way (...) as any other individual or group. Specific rights of minorities in general are granted to minority groups (e.g., “minority groups have the right to speak their own language”) or their members (e.g., “persons belonging to a minority group have the right to speak the language of the group”). Finally, specific rights of particular minorities are granted to specific groups identified by their characteristics (e.g., “the linguistic minority X has the right to speak the X language”) or their members (e.g., “any member of the linguistic minority X has the right to speak the X language”). Treaties and international declarations often refer to universal rights and specific rights of minorities in general. However, these rights are usually recognised in broad terms, and their implementation may lead to the recognition of specific rights in favour of particular minorities or their members. Protection of minorities (in the broad sense of the expression) is based on two pillars: on the one hand, the protection against discrimination; on the other hand, the protection of minorities in the strict sense. The first pillar is an aspect of the general principle of nondiscrimination and requires respect for both formal and substantive equalities. The protection of minorities in the strict sense involves the preservation of their particular identity. The purpose of the equality in a formal sense is achieved through universal rights, to the extent that these are granted to minority groups and their members. On the contrary, to achieve equality in a substantive sense, it could be necessary to implement positive measures. The implementation of these measures will usually lead to the recognition of specific rights of minority groups or their members. Finally, the protection of the distinctive characteristics of the minorities will also be done through specific rights. Thus, on the one hand, there are rights, which are intended to protect the minority forms of life (i.e. to protect differences), and, on the other hand, those that are intended to allow minorities equal access to different uniform social goods (i.e. to protect equality). Whereas the former ones seek to protect and promote the particularities of the minority culture (e.g., the right to receive education in their own language), the latter ones are recognised to overcome the disadvantages that minority groups and their members face and are not intended to promote peculiarities, but rather to permit equal access to resources and social opportunities. Article 27 of the International Covenant on Civil and Political Rights enshrines specific rights of minorities intended to protect and promote their own forms of life. Although economic rights are not mentioned (the article refers to the rights “to enjoy their own culture, to profess and practise their own religion, [and] to use their own language”), they may stem from the explicitly recognised rights. The rights recognised by the Covenant are not collective, but individual rights (“in those States in which ethnic, religious or linguistic minorities exist, persons belonging to such minorities shall not be denied the right [...]”). The rights recognised in the Declaration of the United Nations General Assembly on the Rights of Persons Belonging to National or Ethnic, Religious and Linguistic Minorities are of the same nature. The principle of equality and non-discrimination is contained in Articles 2.1 and 26 of the Covenant. This principle forbids direct and indirect discrimination, be it de iure or de facto. As this is a universal right, minorities can also benefit from it. According to the Human Rights Committee, Article 27 imposes on States the adoption of positive measures that exceed an attitude of mere abstention. In the same way, positive measures may be necessary to make the principle of equality and non-discrimination effective. Although neither Article 27 nor Articles 2.1 and 26 refer to individuals belonging to a specific minority, the concrete implementation of these articles through positive measures may produce specific rights for persons belonging to particular minority groups.     Anyone interested in philosophical argumentation should be prepared to study philosophical debates and controversies because it is an intensely dialogical, and even contentious, genre of argumentation. There is hardly any other way to do them justice. This is the reason why the present special issue addresses philosophical argumentation within philosophical debates. Of the six articles in this special issue, one deals with a technical aspect, the diagramming of arguments, another contrasts two moments in philosophical argumentation, Antiquity and the twentieth century, (...) focusing on the use of refutation, and the remaining four analyze particular philosophical controversies. The controversies analyzed differ significantly in their characteristics (time, extension, media, audience,…). Hopefully, this varied sample will illuminate some salient aspects of philosophical argumentation, its representation and variations throughout history. We are fully aware that, given the scarcity of previous studies of philosophical debates from the perspective of argumentation theory, the following specimens of analysis must have several shortcomings. But it is a well-known adage that the hardest part is the beginning. That is what we tried to achieve here, no more, but no less either. (shrink)

    El Estado es un concepto clave en la filosofía jurídico-política de José Ortega y Gasset (Madrid, 1883-1955). Sin embargo, resulta sorprendente que, pese a la importancia que para este autor tenía dicha noción, no haya sido estudiada con la misma profundidad e interés que otras vertientes de su pensamiento. A este respecto, basta repasar las monografías y los artículos publicados hasta la fecha sobre la figura y la obra de Ortega para constatar que, en términos cuantitativos, las investigaciones dedicadas a (...) la idea orteguiana del Estado han sido apenas testimoniales, y desde luego no son tan significativas como las que se han podido dedicar a otros temas o tópicos más conocidos de su pensamiento. Así pues, el presente libro pretende abordar el estudio de la realidad problemática del Estado en su triple dimensión histórica, sociológica y política. De acuerdo con tal propósito, esta monografía se divide en tres partes: en la primera de ellas, se estudian las instituciones políticas de Roma entendidas por Ortega como precedentes ineludibles para la formación histórica del Estado. La segunda parte de la obra versa sobre el Estado concebido como culminación de lo social, es decir, como órgano diferenciado para el ejercicio del poder público, lo cual conduce indefectiblemente hasta la Teoría de los usos sociales. Por último, la tercera parte se centra en el concepto orteguiano de Estado como forma de organización política, explica la relación que mantienen el Estado y nación en su obra, y expone las líneas principales del programa político pensado por Ortega para modernizar, regenerar y europeizar a España.
