  1. Rethinking medicalization: unequal relations, hegemonic medicalization, and the medicalizing dividend.Michael Halpin &DagobertoCortez -2025 -Theory and Society 54 (2):243-276.
Medicalization is an important theory that has been subject to numerous debates. Drawing on three varied datasets, we forward a relational approach to medicalization that responds to critiques while aiming to reinvigorate the theory with new concepts and questions. In contrast to prior process-based work, our relational approach argues that medicalization is best understood as an action or activity undertaken by specific groups or actors. We further suggest that unequal relations characterize medicalization. Specifically, we argue that 1) groups or actors (...) receive a benefit from participating in medicalization, which we call the medicalizing dividend and, 2) an actor/group occupies a hegemonic position in medicalizing relations, reaping the largest dividend and constraining other actors. While we assert that pharmaceutical companies are currently hegemonic, we argue that their hegemony is not indefinite. We discuss how our approach facilitates links between medicalization and other theories, while outlining future steps for medicalization research. (shrink)

The following article shows the current status of the corporate responsibility inMexico and their effect on risk measured by the cost of capital. To do this, we review the maintheories that show that social practices in the United States leads to decrease risk and hence the costof Capital Aras and Crowther, Richardson and Welker and Diamond y Verrechia. In order to contrast that socially responsible companies have lower capital costs we considersocial performance variable the distinction conferred by the Mexican Center for Philanthropy and the cost of capital it estimate on the methodology of the Capital Asset Price model. We find that companies that are socially responsible have capital costs higher than thosethat are not responsible. It rejects the hypothesis and contrasts with the empirical reality of otherstudies.Keywords. CSR distintive, CEMEFI, cost of capital, risk, return in shares, Capital Market Securities. (shrink)

FDA and the Marketplace of Ideas for Medical Products.NathanCortez -2017 -Journal of Law, Medicine and Ethics 45 (s2):39-41.
The market can produce skewed information about investigational products awaiting FDA approval. But the FDA rarely steps in to correct such misleading information, despite statutory authority to do so. This article evaluates a recommendation by the FDA Transparency Working Group that FDA more clearly signal when and how it will correct misleading information about investigational products, and why such a recommendation is particularly important after the 21st Century Cures Act.

Game Change.MaximoCortez -2015 -Narrative Inquiry in Bioethics 5 (2):5-7.
In lieu of an abstract, here is a brief excerpt of the content:Game ChangeMaximo CortezOn November 17, 1983, I was born with a condition called mixed gonadal dysgenesis, and ambiguous genitalia. My gender was not of a big concern at that time. The more urgent matter was that I had a heart murmur, which was repaired when I was twelve months old. [End Page E5]It was not until I turned five, and by issue of the Texas Children’s Protective Services (CPS), (...) that my mother was forced to authorize providers to perform normalization surgeries on me. An anonymous caller tipped the CPS that my mother was raising a boy as a girl. The state intervened and explained to my mother that she would have to consent to these surgeries or else she would lose custody of me. This included a gonadectomy and a clitorectomy. Without any consent, these surgeries were performed “in my best interests.” My mother was an epileptic, Hispanic, Mormon, single parent.I was raised to be a socially acceptable female, though as early as five, I played with “boy” toys and enjoyed TV programs aimed at male youth, like Teenage Mutant Ninja Turtles. It was not until I had those normalization surgeries performed on me that I felt different. I knew that something major had happened to me. I woke up in a hospital bed in a gown. I raised the covers and noticed that I had an “X” carved in my groin area. Doctors mutilated my clitoris by reducing its size, which made me feel alienated and angry that something was wrong with my body.I had a surgery performed on me that was to be kept secret and never talked about. This sense of fear and shame was instilled in me shortly after the surgery. I do not recall any psychological evaluations or counseling to help me cope with such surgeries. Seeing everyone else my age going through puberty during my teenage years, I felt behind. I wasn’t becoming a boy with a deep voice or facial hair. Instead, I visited the doctor’s office with my mom and was told that I would be taking oral estrogen to become a woman. I wasn’t until that moment that I understood I was seeing a doctor to foster the development of female secondary characteristics. I felt betrayed by the medical community and by my own mother.Just a few years later, I saw a urologist to find out whether I was ready for a vaginal construction surgery (vaginoplasty). Thankfully the urologist suggested that I was not ready to move forward with an invasive and irreversible vaginal construction surgery. I never pursued it as an adult, as I have always felt male gendered.Social sexual relationships have always been difficult for me but more so with my attraction to women. I first realized my attraction to women in early middle school. Being raised Mexican and a Mormon and knowing that I was homosexual created a lot of conflict for me. I felt that I was a male–gendered person forced into a castrated, mutilated, and medically created female body. I suffered through depression from an early age and it continues today. My conservative Mormon upbringing brought me much shame. The Mormon religion, as most people understand it, expresses a great intolerance to homosexuals and transgender people. I felt like I was a heterosexual male in a female’s body, but the Mormons would never accept me.My later teenage years and mid–twenties were a dark time in my life. I even attempted suicide in my early twenties. My depression was treated with antidepressants and talk therapy. Once I began testosterone, I gradually stopped taking antidepressants. When I was only on estrogen, I felt very moody, angry, and in an emotional funk. I would cry easily and would become very irritable and emotional without cause. With testosterone therapy, I began to think more clearly, had balanced emotions, and began to think more logically.I began to research intersex online and found a women’s androgen insensitivity (AIS) support group. At one of their national conferences, I met another intersex individual who was raised as a female and who had transitioned to male. Like me... (shrink)

The Performance of European Socially Responsible Funds.Maria CeuCortez,Florinda Silva &Nelson Areal -2009 -Journal of Business Ethics 87 (4):573-588.
Recent years have witnessed an increasing growth in mutual funds that invest according to social criteria. As a consequence, the financial performance of these portfolios has attracted the interest of academics and practitioners. This paper investigates the performance of a sample of socially responsible mutual funds from seven European countries investing globally and/or in the European market. Using unconditional and conditional models, we assess the performance of these funds in comparison to conventional and socially responsible benchmark portfolios. The results show (...) that European socially responsible funds present in general neutral performance in relation to both conventional and socially responsible benchmarks. However, performance estimates seem to be slightly higher when funds are evaluated in relation to socially responsible indices. Our results also show that socially responsible funds are more exposed to conventional than to socially responsible indices. Furthermore, conventional benchmarks are better able to explain fund returns than socially responsible benchmarks. These findings are robust to both unconditional and conditional models of performance. We also observe that conditional models lead to a slight improvement of performance estimates and to the explanatory power of the models, both when conventional and socially responsible benchmarks are considered. This is consistent with most previous empirical findings on conditional performance evaluation. Our results show that investors who wish to hold European funds can add social screens to their investment choices without compromising financial performance. (shrink)

Of Exterior and Exception: Latin American Rhetoric, Subalternity, and the Politics of Cultural Difference.José M.Cortez -2018 -Philosophy and Rhetoric 51 (2):124-150.
ABSTRACT The question of non-Western difference has come to feature prominently across the field of comparative rhetoric, where it is often presupposed that an irreducible difference separates Western from non-Western rhetorical and cultural production. It is on the basis of this presupposition that critics have established a politics of comparative inquiry, whereby restituting the pure consciousness of a non-Western subaltern subject is understood to subvert the hegemony of Western thought. But what exactly is the nature of this difference? In this (...) article I examine the recent turn toward Latin America in the field of comparative rhetoric to argue that this presupposition serves as a constitutive topos—that the object of Latin America is invented rhetorically in the very act of comparative inquiry—and that this presupposition yields a political impasse that the field has yet to think through. Drawing on recent work in Latin American studies, I argue for a rearticulated notion of subalternity as a methodological approach for dealing with this impasse. (shrink)

(shrink)

“Nietzsche’s Dionysus in Latin America ”. This essay analyzes some of Nietzsche’s readings and, in particular, his representation of Dionysus, which some Latina American lettered elites elaborated in the first quarter of the twentieth century in their quest to legitimize themselves before the expansion of positivist and utilitarian projects that caused a cultural and political deficit in Latin American societies. It is argued, on the one hand, that the recourse to the Dionysius of Nietzsche energized a modernizing movement in the (...) context of modernized societies in the processes of secularization and, on the other hand, that the critical perspective gained by recourse to the Dionysus of Nietzsche did not escape the reproduction of colonial and neocolonial narratives from discourses on “what is ours”, “latino,” “hispanic,” “catholic”, among other formulations. Do Sustainability Signals Diverge? An Analysis of Labeling Schemes for Socially Responsible Investments.Sofia Brito-Ramos,Maria CéuCortez &Florinda Silva -2024 -Business and Society 63 (6):1380-1425.
This article investigates whether sustainability labels for mutual funds in Europe provide consistent signals regarding funds’ sustainable characteristics. Specifically, we assess the alignment of signals conveyed by third-party and self-declared labels. Among the first typology, we consider labels sponsored by government and nonprofit organizations (GNPOs) alongside Environmental, Social, and Governance (ESG) ratings from commercial data vendors. The latter category includes the Sustainable Finance Disclosure Regulation (SFDR) classification and an ESG-related name. Our findings indicate that equity funds with GNPO labels are (...) more likely to exhibit top-tier ESG ratings and alignment with self-declared sustainability signals, namely Article 9 of SFDR and fund names. Furthermore, holding government and multiple GNPO labels is linked to other signals indicating higher sustainability standards. In addition, funds tend to experience an improvement in Morningstar globes after receiving a GNPO label, consistent with GNPO labels signaling funds of the high-quality type. The results regarding label alignment in fixed-income funds are less conclusive. Our findings underscore the need for credible signals in view of the growing number of sustainability labels available to investors. (shrink)

Prospects of Freirean liberating pedagogy in the thoughts of Renato Constantino.Franz Giuseppe F.Cortez -2025 -Educational Philosophy and Theory 57 (1):29-39.
This paper revisits the main thoughts of the Filipino historian and social critic Renato Constantino on the role of education in the formation of a neocolonial and postcolonial consciousness. It suggests that Constantino’s critical stance towards education embodies a type of philosophizing about education that centers on the problematization of the language of instruction, on the rendering of voice to those in the margins of Philippine society, and on taking a critical stance about education itself. It suggests further that this (...) form of philosophizing about education and its instrumentalities is prospective of a Freirean liberating pedagogy that is inherently nonneutral, critical, dialogical, praxical, and transformative.

Palavras-chave: O berço do herói. Argumento ateu. Religião. Nacionalismo. (shrink)

The performance of socially responsible equity mutual funds: Evidence from Sweden.Carlos Leite,Maria CeuCortez,Florinda Silva &Christopher Adcock -2018 -Business Ethics: A European Review 27 (2):108-126.
This paper presents a comprehensive analysis of socially responsible funds in Sweden by assessing fund managers' abilities and performances across different market states. These issues are analyzed at the aggregate and individual fund levels. The paper also presents several new statistical tests that allow more precise inferences about differences in performance and the variability in fund returns arising from different benchmarks. In general, SR and conventional funds perform similarly to the market. At the aggregate level, SR funds investing in Sweden (...) and Europe perform similarly to conventional funds, while those investing globally tend to underperform. This underperformance seems to be linked with poor selectivity abilities of global SR fund managers. For individual funds, the performance of both types of funds is more similar. Most funds perform similarly in crisis periods compared to non-crisis periods. Overall, our results are consistent with a mature market for SR investing and support the view that the similar performance of SR and conventional funds is associated with the mainstreaming of SR investment in Sweden. These findings encourage SR investing both by socially conscious investors, who wish to align their social values with their investment decisions, as well as by conventional investors, who will not be penalized by investing in these funds. We also call attention to the difficulties investors face when trying to identify funds with high social standards, considering that there is scarce information on the extent to which each fund holds stocks that comply with ethical and social criteria. Out-of-Pocket Spending and Financial Equity in the Access to Medicines in Latin America: Trends and Challenges: 2010-2020.RafaelCortez,Andre Medici &Rucheta Singh -2023 -Journal of Law, Medicine and Ethics 51 (S1):17-38.
There is evidence of persistent inequalities in household financial protection of health and drugs spending in Latin America. Despite the expansion of coverage, strong inequalities persist in access to health and family spending on drugs in the region. Out-of-pocket spending in medicines is regressive in greater need for affordable medicines.

The article represents an effort to think recurrent problems in international rela-tions in the context of globalization, from the perspective of concepts developed by Foucault, such as governmentality, biopolitics and dispositive. We present the central conceptions of Foucault in the field of international relations, trying to understand the importance that they have in the discourse analysis concerning failed states. This work represents an advance in the comprehension of problems that can be analyzed from a foucauldian perspective. (shrink)

Online privacy behavior among youth in the Global South.Jan Michael AlexandreCortez Bernadas &Cheryll Ruth Soriano -2019 -Journal of Information, Communication and Ethics in Society 17 (1):17-30.
Purpose The purpose of this paper is two-fold. First, it explores the extent to which diversity of connectivity or the connection through multiple internet access points may facilitate online privacy behavior. Second, it explains the diversity of connectivity-online privacy behavior link in terms of information literacy. Design/methodology/approach Situated in the context of urban poor youth in the Philippines, this paper used a quantitative approach, specifically an interview-administered survey technique. Respondents were from three cities in Metro Manila. To test for indirect (...) relationship, survey data were analyzed using bootstrapping technique via SPSS macro PROCESS. Findings Urban poor youth with diversified connection to the internet engaged in online privacy behavior. The more the youth are connected to the internet through diverse modalities, the more this fosters cautious online privacy behavior. In addition, information literacy explained how diversity of connectivity facilitated online privacy behavior. It suggests that differences in online privacy behavior may result from the extent of basic know-how of navigating online information. In the context of the urban poor in the Global South, the youth are constantly negotiating ways to not only connect to the internet but also acquire digital skills necessary for protective online behaviors. Originality/value To date, this is one of the few papers to contribute to conversations about online privacy among youth in the Global South. It broadens the literature on social determinants of online privacy behavior that is crucial for designing policy interventions for those in the margins. (shrink)

Cristobal Guerra,Cristian Pinto-Cortez,Fabiola Peña,Edgardo Toro,Clara Calia,Corinne Reid &Liz Grant -2022 -Persona y Bioética 25 (2):2524-2524.
Intercultural research poses critical ethical challenges. In 2019, in collaboration with more than 200 researchers from more than 30 countries, a group of researchers developed an ethical conflict analysis model that seems relevant for Latin America. The model proposes a flexible frame of reference where ethical challenges depend on four factors present throughout the research process: the place where the research is carried out, the people involved, the relevant ethical principles, and the precedents from previous research. This article discusses the (...) applicability of this model through two case analyses: one study with Indigenous peoples in Chile and the other with Latin-American migrants on the border between Mexico and US.
