    BackgroundBiobanking biospecimens and consent are common practice in paediatric research. We need to explore children and young people’s (CYP) knowledge and perspectives around the use of and consent to biobanking. This will ensure meaningful informed consent can be obtained and improve current consent procedures.MethodsWe designed a survey, in co-production with CYP, collecting demographic data, views on biobanking, and consent using three scenarios: 1) prospective consent, 2) deferred consent, and 3) reconsent and assent at age of capacity. The survey was disseminated (...) via the Young Person’s Advisory Group North England (YPAGne) and participating CYP’s secondary schools. Data were analysed using a qualitative thematic approach by three independent reviewers (including CYP) to identify common themes. Data triangulation occurred independently by a fourth reviewer.ResultsOne hundred two CYP completed the survey. Most were between 16–18 years (63.7%, N = 65) and female (66.7%, N = 68). 72.3% had no prior knowledge of biobanking (N = 73).Acceptability of prospective consent for biobanking was high (91.2%, N = 93) with common themes: ‘altruism’, ‘potential benefits outweigh individual risk’, 'frugality', and ‘(in)convenience’.Deferred consent was also deemed acceptable in the large majority (84.3%, N = 86), with common themes: ‘altruism’, ‘body integrity’ and ‘sample frugality’. 76.5% preferred to reconsent when cognitively mature enough to give assent (N = 78), even if parental consent was previously in place. 79.2% wanted to be informed if their biobanked biospecimen is reused (N = 80).ConclusionProspective and deferred consent acceptability for biobanking is high among CYP in the UK. Altruism, frugality, body integrity, and privacy are the most important themes. Clear communication and justification are paramount to obtain consent. Any CYP with capacity should be part of the consenting procedure, if possible. (shrink)

    With the outbreak of severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2), global researchers were confronted with major challenges. The German National Pandemic Cohort Network (NAPKON) was launched in fall 2020 to effectively leverage resources and bundle research activities in the fight against the coronavirus disease 2019 (COVID-19) pandemic. We analyzed the setup phase of NAPKON as an example for multicenter studies in Germany, highlighting challenges and optimization potential in connecting 59 university and nonuniversity study sites. We examined the ethics application (...) process of 121 ethics submissions considering durations, annotations, and outcomes. Study site activation and recruitment processes were investigated and related to the incidence of SARS-CoV-2 infections. For all initial ethics applications, the median time to a positive ethics vote was less than two weeks and 30 of these study sites (65%) joined NAPKON within less than three weeks each. Electronic instead of postal ethics submission (9.5 days (Q1: 5.75, Q3: 17) vs. 14 days (Q1: 11, Q3: 26), p value = 0.01) and adoption of the primary ethics vote significantly accelerated the ethics application process. Each study center enrolled a median of 37 patients during the 14-month observation period, with large differences depending on the health sector. We found a positive correlation between recruitment performance and COVID-19 incidence as well as hospitalization incidence. Our analysis highlighted the challenges and opportunities of the federated system in Germany. Digital ethics application tools, adoption of a primary ethics vote and standardized formal requirements lead to harmonized and thus faster study initiation processes during a pandemic. (shrink)

    RATIONAL ALTRUISM. A PRUDENTIAL THEORY OF RATIONALITY AND ALTRUISM - STRUCTURE: "Rational altruism" is the attempt to develop and rationally justify moral principles - with a very strong emphasis on this justification. The concept of justification is developed in a metaethical part (ch. 2); it requires recourse to prudential decisions and to information about our decision-making procedures. The actual normative ethics (Ch. 6 and especially 7) is therefore still based on a prudential desirability theory (Ch. 4 and Sections 5.5-5.6) and (...) this in turn on an empirical action theory (Ch. 3 and Sections 5.1-5.4). - METAETHICS (Ch. 2): In the metaethical part of the book, conditions of adequacy for cogent moral justifications are first developed and justified, which demand, among other things, an information-stable motivation through cogent moral justifications (internalist moral justification). After an examination of various approaches to justification in ethics with regard to this adequacy condition and the negative outcome of this examination, an alternative solution strategy is presented. Among other things, the rationality requirements of profane rational reasoning approaches in ethics are to be systematically reinforced by a prudential desirability theory that aims at information-stable evaluations. - EMPIRICAL THEORY OF ACTION (Chapter 3 and Sections 5.1-5.4): The empirical theory of action developed here therefore provides a detailed analysis of the regularities and leeway of our decisions, especially the influence of information on decision-making paths. - PRUDENTIAL DESIRABILITY THEORY (Chapter 4 and Sections 5.5-5.6): In the prudential desirability theory, the 'individual desirability' of events, especially actions, is then defined in such a way that, of the various evaluation possibilities, the one that is stable in terms of information is always chosen. This procedure far exceeds the rationality requirements of rational decision theory, for example. - NORMATIVE ETHICS (chap. 6 and especially 7): Finally, in the actual normative ethics, a prioritarian standard for the moral evaluation of actions, norms and entire social orders is developed, called "Utilex". Utilex is based on compassion and, like compassion, is partial to the worse off, the poor and unfortunate, but without neglecting the interests of the better off. (shrink)

Die Idee der Autonomie, die für die moderne praktische Philosophie seit Rousseau und Kant grundlegend ist, zielt so darauf, Freiheit und Verbindlichkeit in einem Zuge zu artikulieren: durch die Form selbstgegebener Gesetze.     Most contemporary legal philosophers tend to take force to be an accessory to the law. According to this prevalent view the law primarily consists of a series of demands made on us; force, conversely, comes into play only when these demands fail to be satisfied. This book claims that this model should be jettisoned in favour of a radically different one: according to the proposed view, force is not an accessory to the law but rather its attribute. The law is (...) not simply a set of rules incidentally guaranteed by force, but it should be understood as essentially rules about force. The book explores in detail the nature of this claim and develops its corollaries. It then provides an overview of the contemporary jurisprudential debates relating to force and violence, and defends its claims against well-known counter-arguments by Hart, Raz and others. This book offers an innovative insight into the concept of Pure Theory. In contrast to what was claimed by Hans Kelsen, the most eminent contributor to this theory, the author argues that the core insight of the Pure Theory is not to be found in the concept of a basic norm, or in the supposed absence of a conceptual relation between law and morality, but rather in the fundamental and comprehensive reformulation of how to model the functioning of the law intended as an ordering of force and violence.     We present a computer-supported approach for the logical analysis and conceptual explicitation of argumentative discourse. Computational hermeneutics harnesses recent progresses in automated reasoning for higher-order logics and aims at formalizing natural-language argumentative discourse using flexible combinations of expressive non-classical logics. In doing so, it allows us to render explicit the tacit conceptualizations implicit in argumentative discursive practices. Our approach operates on networks of structured arguments and is iterative and two-layered. At one layer we search for logically correct formalizations for each (...) of the individual arguments. At the next layer we select among those correct formalizations the ones which honor the argument’s dialectic role, i.e. attacking or supporting other arguments as intended. We operate at these two layers in parallel and continuously rate sentences’ formalizations by using, primarily, inferential adequacy criteria. An interpretive, logical theory will thus gradually evolve. This theory is composed of meaning postulates serving as explications for concepts playing a role in the analyzed arguments. Such a recursive, iterative approach to interpretation does justice to the inherent circularity of understanding: the whole is understood compositionally on the basis of its parts, while each part is understood only in the context of the whole. We summarily discuss previous work on exemplary applications of human-in-the-loop computational hermeneutics in metaphysical discourse. We also discuss some of the main challenges involved in fully-automating our approach. By sketching some design ideas and reviewing relevant technologies, we argue for the technological feasibility of a highly-automated computational hermeneutics. (shrink)

    La « règle d’or » énoncée par Lc 6,31 et Mt 7,12, à laquelle Kant reproche son caractère imparfaitement formel, est interprétée par Paul Ricœur, dans Soi-même comme un autre , comme une règle de « réciprocité », née de la « sollicitude » envers autrui, affrontée à la violence, qui permet de gérer les conflits entre l’universalité de la loi et le bien particulier et de faire la « transition » entre une morale du devoir et des convictions de (...) sagesse pratique.Mais nous nous interrogeons sur la discordance, observée par Ricœur, entre une logique d’équivalence qui régirait l’éthique commune et une logique de la surabondance qui relèverait de l’économie du don et de la référence à Dieu, discordance qui entraînerait, selon lui, une répartition des tâches entre la philosophie, agnostique par statut, et la théologie.D’un côté, une logique d’excès ou d’amour est déjà à l’œuvre dans la sollicitude éthique pour permettre à quelqu’un de se mettre à la place de l’autre. D’autre part, la solidarité impliquée par la règle d’or évangélique trouve en elle-même la force de s’accomplir au delà de toute justice. La théologie peut ainsi rejoindre la philosophie dans son « agnosticisme » : la règle d’or est le lieu où Dieu se cache et en même temps se montre dans la spontanéité éthique de la conscience humaine.The “Golden Rule” announced by Luke 6,13 and Matthew 7,12, of which Kant criticized its imperfectly formal character, was interpretated by Paul Ricœur in Soi-même comme un autre as a rule of “reciprocity”. It was born of “solicitude” towards the other, affronted by violence, and permitted the management of conflicts between the universality of the law and the private good, and made the “transition” between a morality of duty and the convictions of practical wisdom.But we ask ourselves about the discordance, observed by Ricœur, between a logic of equivalence the regulated common ethics and a logic of surabundance that arose from an economy of gift and from a reference to God. That discordance brought with it, according to him, a repartition of tasks between philosophy, agnostic by status, and theology.On the one hand, a logic of excess where love is already at work in the ethical solicitude to allow someone to put himself in the place of the other. On the other hand, the solidarity implied by the evangelical golden rule finds in itself the force to come about beyond all justice. Theology can thus rejoin philosophy in its “agnosticism” : the golden rule is the place where God hides and at the same time appears in the ethical spontaneity of the human conscience. (shrink)

    According to Fred Dretske's externalist theory of knowledge a subject knows that p if and only if she believes that p and this belief is caused or causally sustained by the information that p. Another famous feature of Dretske's epistemology is his denial that knowledge is closed under known entailment. I argue that, given Dretske's construal of information, he is in fact committed to the view that both information and knowledge are closed under known entailment. Hence, if it is true (...) that, as Dretske also believes, accepting closure leads to skepticism, he must either embrace skepticism or abandon his information theory of knowledge. (shrink)

    This paper explores the phenomenon of meta-emotions. Meta-emotions are emotions people have about their own emotions. We analyze the intentional structure of meta-emotions and show how psychological findings support our account. Acknowledgement of meta-emotions can elucidate a number of important issues in the philosophy of mind and, more specifically, the philosophy and psychology of emotions. Among them are (allegedly) ambivalent or paradoxical emotions, emotional communication, emotional self-regulation, privileged access failure for repressed emotions, and survivor guilt.
