Siguiendo la redacción de la reivindicación independiente de producto número 1, D01 describe un dispositivo de identificación de personas compuesto, entre otros, por los siguientes elementos técnicos: -Tarjeta dotada de un chip o circuito de memoria que contiene información digitalizada y encriptada (ver párrafos [0062] a [0065]) incluyendo firma digitalizada (ver párrafo [0125]). En relación a la reivindicación independiente número 1 y teniendo en cuenta el contenido de D01 se concluye que R1 carece de novedad en el sentido del artículo 6.1 de la Ley de Patentes puesto que todos los elementos técnicos que permiten la resolución del problema técnico planteado (es decir, una tarjeta provista de circuito de memoria) se encuentran descritos en D01 donde desarrollan la misma función técnica que se les atribuye en R1 (es decir, almacenar determinada información dentro del chip de memoria). En este sentido, es importante destacar que, el significado la de información concreta que se almacena dentro del circuito de memoria (nombres, fechas, documentos, certificados, etc…) no aporta novedad a la invención puesto que no se deriva ningún efecto sorprendente o inesperado de la introducción de uno u otro tipo de información. R2 carece de novedad del mismo modo que la reivindicación independiente de la cual depende. Por lo que respecta a la reivindicación independiente de procedimiento número 3, se considera D01 el documento más cercano dentro del estado de la técnica. Siguiendo la redacción de R3, D01 describe un método de uso de tarjetas con chip incorporado que consta, entre otras, de las siguientes etapas: -Creación de una tarjeta dotada de chip o circuito de memoria que almacena determinada información (ver párrafos [0062] a [0065]) e incluye firma digitalizada (ver párrafo [0125]). -Introducción de la tarjeta en un lector de tarjetas y visualización de la información que contiene (ver figura 1). En base a lo anterior, se concluye que R3 carece de novedad en el sentido del artículo 6.1 de la Ley de Patentes puesto que las etapas descritas en R3 se encuentran idénticamente descritas en D01. Por lo que respecta a las reivindicaciones dependientes números R4 a R8, se considera que éstas carecen novedad puesto que, no introducen ningún elemento técnico diferencial con respecto a D01 y las diferencias que se plantean entre las reivindicaciones y D01 (por ejemplo el hecho de que en D01 no se hable específicamente de la comprobación de la firma digital o de la incorporación de los datos a bases de datos), se consideran características técnicas implícitas.
