SUMMARY
This enactment amends theFisheries Act in order to exclude raw sewage from the definition of deleterious substance so as to entirely prohibit its deposit in water.

Her Majesty, by and with the advice and consentof the Senate and House of Commons of Canada,enacts as follows:

Fisheries Act
1 (1) Subsection34(1) of theFisheries Act is amended by adding the following in alphabetical order:
raw sewage means sewage that has not yet been processed or treated to separate and remove contaminants, and includes
(a) used water from sanitary appliances that contains human fecal matter or human urine,
(b) used water, other than the type of water described in paragraph (a), from sanitary appliances or from other appliances in a kitchen or laundry, and
(c) surface runoff and stormwater that is mixed with the type of water described in paragraph (a); (eaux usées non traitées)

(2) The portion of the definitiondeleterious substance in subsection34(1) of the Act after paragraph (b) and before paragraph (c) is replaced by the following:
and, without limiting the generality of the foregoing, Insertion startdoes not include raw sewage, but Insertion end includes
2 Section36of the Act is amended by adding the following after subsection (3):
Deposit of raw sewage prohibited
Start of inserted block(3.1) No person shall deposit or permit the deposit of raw sewage in water frequented by fish.

Start of inserted block(3.2) Subsection (3.1) does not apply in respect of Canadian fisheries waters located
(a) in the Northwest Territories;
(b) in Nunavut; or
(c) north of the54th parallel in Quebec or Newfoundland and Labrador.

3 The portion of subsection40(2) of the Act before paragraph (a) is replaced by the following:
Offence and punishment
(2) Every person who contravenes subsections36(1), (3) or Insertion start(3.1) Insertion end is guilty of an offence and liable

4 This Act comes into force five years after the day on which it receives royal assent.
