SUMMARY

This enactment amends theCriminal Code to require that a presentence report contain information on any aspect of the offender’s mental condition that is relevant for sentencing purposes.

Her Majesty, by and with the advice and consentof the Senate and House of Commons of Canada,enacts as follows:

R.‍S.‍, c. C-46

Criminal Code

1Subsection721(3) of theCriminal Code is amended by adding the following after paragraph (a):

  • Start of inserted block

    (a.‍1)any aspect of the offender’s mental condition that is relevant for sentencing purposes, as well as any mental health services or support available to the offender;

    End of inserted block
