Judge John W. Albaugh of Canton, Ohio, who had a distinguished career in law. He was the son of Ezra Albaugh and was born July 4, 1844; rear on a farm near New Cumberland, Tuscarawas County, Ohio. He attended common schools until he was seventeen years of age, and then taught school several terms in succession. He received a good education having attended Academy in Plymouth, Ohio, and also several terms in New Cumberland. He began to read law, with Judge Patrick of New Philadelphia, in 1866, and was admitted to the bar, April 25, 1869. Shortly after his admission to the Bar he formed a partnership with Judge J. H. Barnhill and began the practice of Law in New Philadelphia. He was elected Justice of the Peace in 1871, and served eighteen months. He was elected Prosecuting Attorney for Tusacarawas County, in 1872. He resigned the office of Justice of the Peace to accept the Prosecutor's Office. He served two terms in that office and then engaged in general practice.
In 1875 he formed a law partnership with Hon. John S. Graham, of Philadelphia, a brother-in-law, which continued until August 1882, when he changed location and moved to Canton, Ohio, and formed partnership with Hon. John C. Wolry. This continued until 1884, when he was nominated and elected Judge of the Circuit Court of the Fifth Judicial District of Ohio, composed under the amended Constitution of the State, which abolished that office.
His was the first election for Circuit Judges under the amended Constitution of the State, which abolished the old District Court, and established the Circuit Court. The Statute provided that all of the Judges would expire every two years. The Governor and Secretary of State cast lots for the length of terms which were two, four and six years, and the Statute also provided that the judge holding the short term should preside for two years. He was re-elected at the end of his term, for six years, and in all served eight years on the Circuit Bench. This experience on the Bench has been of great benefit to him in his practice, since. The duties of judge of the Circuit Bench were very burdensome and important.
At the expiration of his judicial career he entered the law practice, again, with Hon. John C. Welty, in Canton, with whom he has been connected ever since. They enjoy a large practice and are connected with nearly all the most important cases in the Stark County Courts.
He belongs to the Democratic Party, and before he went upon the Bench, he had quite an active part in politics. He has spoken in nearly all parts of Tuscarawas, Carroll and Stark Counties, and in 1880 was engaged in the State Campaign, and made a great many speeches, especially in the western part of the State.
He was married to Estrella Seran, August 18, 1866. Mrs. Albaugh was born and brought up on a farm. Her father was a most exemplary and worthy citizen; he was an extensive farmer, and owned at the time of his death, in April 1896, nearly four hundred acres of land. Mrs. Albaugh was born in 1847. Her mother is living on the old homestead near New Cumberland. The family of Judge Albaugh consists of two sons, Thurlow K. Albaugh, born July 11, 1868, and Walter A. Albaugh born April 25, 1879.


John served in the Union Army during the Civil War. He enlisted as a Sergeant on August 6, 1862 at the age of 18. He enlisted in Company G, 126th Infantry Regiment Ohio on September 5, 1862. Promoted to Full Private on October 9, 1862 (at his own request reduced to ranks). He received a disability discharge on January 23, 1863. He applied for a pension (#123696310) in October 1899. His widow, Estella Albaugh applied for a pension (#161853209) in July 1829.
