COHABITATION, the act of a man andwoman in living together as husband and wife.It does not necessarily include the notion ofsexual intercourse between the parties, but iscommonly held, even in law, to do so, and thisis always the case when the parties areunmarried. Applied to husband and wife it maymean onlyconsortium. Cohabitation raises alegal presumption of marriage between theparties cohabiting, which may be rebutted byother evidence. SeeMarriage.
