Texas Proposition 8, officially theProhibit Taxes on a Decedent's Property or Estate Transfer Amendment , is alegislatively referred constitutional amendment that appeared on the ballot in theU.S. state ofTexas on November 4, 2025. The measure proposed amending thestate constitution to prohibit thestate legislature from imposing a tax on a deceased person's property or the transfer of an estate, inheritance, legacy, succession, or gift.[ 1] It was widely approved by voters, passing in 253 of the state's 254 counties.[ 2]
Until September 2015,Texas had aninheritance tax . It was repealed by thestate legislature inSenate Bill 752 .[ 1] Texas is one of the 38 U.S. states that has noestate tax .[ 3]
The measure was supported by theLibertarian Party of Texas and opposed by theGreen Party of Texas ,[ 1] while theRepublican Party of Texas remained neutral.[ 4]
Proposition 8 added a new section to Article 8 of theTexas Constitution , prohibiting the state legislature from:
imposing astate tax on an estate or inheritance tax after an individual's death[ 5] imposing a state tax on the transfer of an estate or inheritance from one individual or family to another[ 5] increasing the rate of atransfer tax or expanding who the tax applies to[ 5] The measure also amended the state constitution to exempt gifts of motor vehicles orproperty taxes from the ban.[ 5]
