Therefore, if the subject internet draft(s) is adopted by IETF as a standard track RFC and it is technically unavoidable to implement the subject patent to implement such IETF standard, Softbank has the intention to grant licenses for the subject patent under Fair, Reasonable, and Non-Discriminatory (FRAND) terms. However, this is subject to the prerequisite that Softbank and its subsidiaries (as defined below) can implement any specifications standardized in IETF under equivalent conditions as this license. Definition of subsidiaries: Subsidiaries refer to companies controlled by Softbank, where ""control"" means the direct or indirect ownership of more than 50 percent of the voting shares or equivalent voting rights after the issuance of this declaration, and the authority to exercise significant influence over the management of the company, either directly or indirectly. |
