ThePennsylvania Commissioner of Insurance is a state executive position in the Pennsylvania state government.
In Pennsylvania, and 38 other states, the insurance commissioner is appointed by thegovernor, who nominates a candidate for approval by the Pennsylvania Senate. The commissioner is responsible for overseeing the Pennsylvania Insurance Department, which regulates the insurance industry by monitoring the financial solvency of insurance companies and reviewing insurance rates, among other initiatives.[1]

The current Pennsylvania Commissioner of Insurance isMichael Humphreys (nonpartisan). Humphreys assumed office in 2023.
Authority
Though thestate constitution does not specifically create the office of insurance commissioner, it does allow for the addition of public officers inArticle IV, Section 1:
All officers, whose selection is not provided for in this Constitution, shall be elected or appointed as may be directed by law.[2] |
Given this authority, thegeneral assembly created the department in 1873 and reorganized the department in 1921.[1]

Appointments
The commissioner of insurance is not elected in Pennsylvania. Thegovernor nominates a candidate to thePennsylvania Senate. The Senate confirms the nominee by a two-thirds majority before the candidate takes the oath of office.[2]
Vacancies
Article IV, Section 8 of thePennsylvania Constitution grants the governor the power to appoint officers to fill vacancies. In the event of a vacancy in the office of insurance commissioner, the governor nominates a successor. This nomination must be made to the Senate within 90 days of the vacancy. The Senate must then take action (confirming or not confirming the nomination) within 25 legislative days.[2]

The Insurance Department website describes the commissioner's duties as "regulating the Commonwealth’s insurance marketplace, overseeing licensed agents and insurance professionals, monitoring the financial landscape of companies doing business in Pennsylvania, educating consumers, and ensuring residents are treated fairly."[3]

Compensation
The commissioner's salary is set by statute and subject to cost-of-living adjustments, also known as COLAs, pursuant to Section 3(e) of the Public Official Compensation Law (amended in 1995). This law mandates that Pennsylvania executives' salaries "shall be increased by applying the percentage change in the Consumer Price Index for All Urban Consumers (CPI-U) for the Pennsylvania, New Jersey, Delaware and Maryland area for the most recent 12-month period for which figures have been officially reported by the United States Department of Labor, Bureau of Labor Statistics (BLS) immediately prior to the date adjustment is due to take effect."[6]
