Scott Hardy was nominated by PresidentDonald Trump (R) to replace Fischer on the Western District of Pennsylvania. Hardy was confirmed on July 27, 2020.

A native ofHomestead, Pennsylvania, Fischer graduated from St. Mary`s College with her bachelor's degree in 1973 and from Notre Dame Law School with herJ.D. in 1976.[1]

Fischer was first nominated by PresidentGeorge W. Bush on July 13, 2006, to a seat on theUnited States District Court for the Western District of Pennsylvania vacated byRobert Cindrich. TheAmerican Bar Association rated FischerUnanimously Well Qualified for the nomination. Hearings on Fischer's nomination were held before theSenate Judiciary Committee on September 12, 2006, and her nomination was reported by U.S. Sen. Arlen Specter (R-Pa.) on September 29, 2006. Under provisions of Rule XXXI, paragraph six of the standing rules of the Senate, Fischer's nomination was returned to the president on December 9, 2006. President Bush resubmitted the nomination on January 9, 2007, and her nomination was reported byJudiciary Committee ChairmanPatrick Leahy (D-Vt.) on February 8, 2007, without additional hearings. Fischer was confirmed on a recorded 96-0 vote of theU.S. Senate on February 14, 2007, and she received her commission on April 2, 2007. Fischer assumedsenior status on June 13, 2019.[1][2][3][4]

On May 28, 2010, Judge Fischer ordered that a lawsuit by ACORN must proceed despite challenges to dismiss the case. ACORN sued the state ofPennsylvania over a state law banning the use of quotas in voter registration drives.Attorney GeneralTom Corbett argued to have the case dismissed on the basis of ACORN shutting down. In 2011, Judge Fischer dismissed the suit.[5][6]
