The ballot title for Initiative Measure 409 was as follows:

Shall the Nebraska Constitution be amended to: instruct Nebraska's members of Congress and state legislators to support passage and ratification of an amendment to the U.S. Constitution limiting U.S. Representatives to three terms and Senators to two terms; inform voters of the position of candidates for Congress and legislature on the specified congressional term limits by placing language on election ballots; and instruct state legislators to apply to Congress to convene an Article V Convention for the propose of proposing an amendment to the U.S. Constitution to limit congressional terms? A vote FOR will amend the Constitution of Nebraska by adding a new provision which would instruct Nebraska's members of Congress and state legislators to support passage and ratification of an amendment to the U.S. Constitution limiting U.S. Representatives to three terms and Senators to two terms; inform voters of candidates' position on these term limits; and instruct the Nebraska legislature to apply to Congress to convene an Article V Convention to propose an amendment to the U.S. Constitution to limit Congressional terms.

A vote AGAINST will not cause the Constitution of Nebraska to be amended in such a manner.

Aninitiated constitutional amendment is acitizen-initiated ballot measure that amends astate's constitution. Eighteen (18) states allow citizens to initiate constitutional amendments.

In Nebraska, thenumber of signatures required for an initiated constitutional amendment is equal to 10% of registered voters at the signature deadline. Nebraska also has adistribution requirement that requires initiative proponents to collect signatures from 5% of the registered voters in two-fifths (38) of Nebraska's 93 counties. A simple majority vote is required for voter approval. However, the number of affirmative votes cast for the measure must be greater than 35% of the total votes cast in the election. This also applies to legislative referrals.
