Schwartz was nominated by PresidentJimmy Carter on September 28, 1979, to a new seat created by 92 Stat. 1629; he was confirmed by the Senate on November 26, 1979, and received commissionthe next day. He assumedsenior status onJanuary 20, 1990. He served the Eastern District of California until his resignation onOctober 3, 2005. Schwartz was succeeded in this position byOliver Wanger.
