Joseph McKinley
Joseph H. McKinley, Jr. is afederal judge onsenior status for theUnited States District Court for the Western District of Kentucky. He joined the court in 1995 after being nominated by PresidentBill Clinton. He assumedsenior status on June 9, 2019. McKinley was thechief judge of the court from 2011 to 2018.
Early life and education
Born in Owensboro,Kentucky, McKinley graduated from the University of Kentucky in Lexington in 1976 and from the University of Louisville Law School with his Juris Doctor degree in 1979.[1]
Professional career
McKinley was a private practice attorney inOwensboro, KY from 1979 to 1991. McKinley also served as a commissioner for the Kentucky Oil and Gas Conservation Commission from 1982 to 1990. McKinley was a part-time assistant county attorney forDaviess County from 1985 to 1987 and later served as a hearing officer for the Kentucky Natural Resources and Environmental Protection Cabinet from 1990 to 1991. In 1992, McKinley was elected judge for theDaviess County Circuit Court until 1995.[1]
Judicial Career
Western District of Kentucky
On the recommendation of Senator Wendell Ford, McKinley was nominated to theUnited States District Court for the Western District of Kentucky by President Bill Clinton on May 24, 1995, to a seat vacated byRonald Meredith. McKinley was confirmed by the Senate on August 11, 1995, on a Senate vote. He received commission onAugust 14, 1995. He assumedsenior status on June 9, 2019. McKinley was thechief judge of the court from 2011 to 2018.[2][1]
Noteworthy cases
Federal tobacco case (2009)
Judge McKinley presided in the case involving federal tobacco marketing laws. Major tobacco companies, includingPhilip Morris and RJ Reynolds, sued the Food and Drug Administration on new regulations of tobacco products in terms of marketing of the products. The judge found no evidence that the FDA violated First Amendment rights through increased marketing regulation.[3]
