On April 4, 2013, Judge Korman ordered that the federal Food and Drug Administration allow women of all ages to access the Plan B "Morning After" contraceptive pill over the counter without a prescription. Previously, the FDA required that women under the age of sixteen be issued a prescription in order to obtain the drug. In his ruling, Judge Korman ordered that the FDA must make the pill and its generic versions available within thirty days.[2]

TheJustice Department promised to appeal Korman's ruling, claiming that citizens were "better served when the government acts deliberately and incrementally."[3] Following the ruling, the Food and Drug Administration announced its intention to provide over the counter sales of Plan B to individuals over the age of 15 with photo identification. During a hearing on the ruling's appeal, Judge Korman said this policy would have the following effect, "The poor, the young and African-American are going to be put in the position of not having access to this drug."[3]

In June 2013, the Food and Drug Administration agreed to allow individuals to purchase Plan B One-Step over the counter without a prescription or any age restrictions. With its compliance, the agency dropped its appeal of Judge Korman's April ruling.[4]
