Smith was nominated to theUnited States District Court for the Northern District of Alabama by PresidentBill Clinton onDecember 8, 1995, to a seat vacated byElbert Haltom. TheAmerican Bar Association rated SmithUnanimously Well Qualified for the nomination. Hearings on Smith's nomination were held before theSenate Judiciary Committee on December 19, 1995, and his nomination was reported by U.S. Sen.Orrin Hatch (R-Utah) on December 21, 1995. Smith was confirmed on a voice vote of theU.S. Senate on December 22, 1995, and he received his commission on December 26, 1995. Smith elected to takesenior status beginning on August 31, 2013.[1][3][4]

Judge puts an end to drug-testing for new county government employees (2014)

In April 2014, Judge Smith ruled that new government employees inJefferson County, Alabama, would not have to be drug tested prior to hiring, as he reasoned that the practice conflicted with theFourth Amendment. Judge Smith agreed with Ronald Sims, the court-appointed receiver who first ordered that the drug testing be halted due to constitutional concerns.
