Lucero was nominated to theUnited States Court of Appeals for the 10th Circuit byBill Clinton on March 23, 1995, to a new seat created by 104 Stat. 5089. TheAmerican Bar Association rated LuceroUnanimously Well Qualified for the nomination.[4] Hearings on Lucero's nomination were held before theUnited States Senate Committee on the Judiciary on June 6, 1995, and his nomination was reported by U.S. Sen.Orrin Hatch (R-Utah) on June 22, 1995. Lucero was confirmed on a voice vote of theU.S. Senate on June 30, 1995, and he received his commission the same day.[1][5]

Noteworthy cases

States cannot require citizenship documents to register to vote (2014)

On November 10, 2014, theTenth Circuit struck down requirements inKansas andArizona mandating voting registrants to show citizenship documents when registering to vote. A three-judge panel of the Tenth Circuit, consisting of JudgesCarlos Lucero,Jerome Holmes andGregory Alan Phillips, held that the states lacked the authority to require the federal government to include citizenship documents as a requirement on the voter registration form, which the states argued was required to comply with the states’ own laws. Judge Lucero, writing for the panel, said that the states failed to show that requiring proof of citizenship in any way decreased fraudulent voting.
