Petrol is an essential good for most households, and there is no way of knowing what you're putting in your tank other than relying on the signage provided by the retailer. The Federal Court has ordered Mobil Oil Australia to pay $16 million in penalties for making false or misleading representations about the fuel sold at 9 petrol stations in north and central Queensland, in breach of the Australian Consumer Law.Mobil admitted that for varying periods between August 2020 and July 2024 it made false or misleading claims to consumers through branding and signage which indicated that the fuel being sold was 'Mobil Synergy Fuel' containing certain additives. In fact, Mobil Synergy Fuel was not sold at these 9 sites, and the fuel supplied at these sites was the same or substantially the same as unadditised fuel at other non-Mobil retail sites.Mobil also admitted that it made false or misleading representations to consumers through a range of signage and branding at the 9 petrol stations that promoted the benefits of Mobil Synergy Fuel."We consider it very likely that some people chose to fill up at these petrol stations because they thought they were getting a different quality of petrol with particular benefits for their car." -Mick Keogh, ACCC Deputy Chair.Read more:https://brnw.ch/21x007J
How do competition regulators keep pace as markets, technology and economies evolve? 💭Earlier this month,Gina Cass-Gottlieb, ACCC Chair, andRachel Burgess, Executive Director of International Engagement, joined senior leaders in Tokyo for the 20th East Asia Top Level Officials' Meeting on Competition Policy (EATOP) and the 17th East Asia Conference (EAC).Hosted this year by theJapan Fair Trade Commission in collaboration with the Asian Development Bank Institute (ADBI) andAsian Development Bank (ADB), this gathering celebrated a significant 20-year milestone for EATOP. For two decades, this forum has been essential for strengthening cooperation across East and Southeast Asia.A central focus this year was the advancement of digital competition policy. Leaders explored how emerging tools like artificial intelligence can be used to tackle anti-competitive conduct.During a dedicated panel session on the use of economic analysis, Gina shared how the ACCC navigates the practical challenges of competition enforcement, highlighting the importance of clear and transparent data.Gina also emphasised that as our economies and markets evolve, deepening cooperation with our regional partners is key to building our collective expertise.By aligning our strategies today, we are ensuring that the markets of tomorrow remain fair, open, and driven by innovation for the benefit of consumers across the region.
Today, ACCC andAustralian Energy Regulator (AER) employees gathered across our offices to mark the launch of the ACCC and AER's new Reconciliation Action Plan (RAP). The RAP reflects our ongoing commitment to strengthening relationships, building respect and expanding opportunities for First Nations peoples across our organisation.Launching the RAP on the anniversary of the National Apology provided an important moment to acknowledge the profound grief and loss experienced by Aboriginal and Torres Strait Islander peoples, particularly the Stolen Generations, and to reaffirm our responsibility to contribute to meaningful reconciliation. We were grateful to hear from Professor Mark Rose, whose insights on embedding First Nations culture and knowledge into organisational practice will help guide the implementation of our RAP. This launch represents a shared commitment across the ACCC and AER, supported by our Senior Reconciliation Champions, to continue strengthening unity, respect and cultural capability throughout our work.

Participants in the National Disability Insurance Scheme (NDIS) are being targeted by NDIS providers' deceptive advertising practices and other behaviours banned by consumer law, a new report has found.Working in a taskforce with theNational Disability Insurance Agency (NDIA) and theNDIS Quality and Safeguards Commission, we have identified trends of problematic conduct that may breach the Australian Consumer Law, including instances of providers wrongly charging for essential disability support products that were not supplied as agreed and falsely claiming services or products are 'NDIS-approved or eligible for NDIS funding', when this is not the case. Whilst practices are not universal, the scale and types of complaints we’re hearing about is concerning."Harm [from consumer law breaches] can range from financial loss and life-limiting impacts, to compromising the safety and physical wellbeing of NDIS participants. Such conduct is completely unacceptable and the ACCC will continue to work with taskforce agencies to protect NDIS participants, educate and hold providers that continue to do the wrong thing accountable." -Catriona Lowe, ACCC Deputy Chair.Find out more about our action in this space:https://brnw.ch/21wZNxK
