MAGISTRATES' COURT ACT 1989 - SECT 9C

Chief Magistrate may engage reserve magistrate to undertake duties of a magistrate

    (1)     The ChiefMagistrate may, from time to time,by notice in writing, engage areserve magistrate to undertake the duties of amagistrate

        (a)     on a full time basis; or

        (b)     on a sessional basis.

    (2)     Without limiting subsection (1), an engagementunder that subsection must specify the period of the engagement.

    (3)     The ChiefMagistrate does not have the powerto revoke or amend a notice of engagement under subsection (1), other thanwith the consent of thereserve magistrate.

    (4)     An engagement under subsection (1) must notexceed 6 months.

    (5)     For the purpose of deciding whether, when, oron what basis to engage areserve magistrate to undertake duties, the ChiefMagistrate may request thereserve magistrate to provide any information thatthe ChiefMagistrate considers may be relevant to enable a decision to engageto be made.
