MAGISTRATES' COURT ACT 1989 - SECT 4V

Adjournment of proceeding in Assessment and Referral Court List

    (1)     The Court, at any time before taking a formalplea from theaccused in a criminalproceeding which has been referred to theAssessment and Referral Court List, may adjourn aproceeding in that List forthe purposes of a clinical assessment of theaccused to—

        (a)     identify theaccused's needsbased on the needs criteria set out insection 4T; and

        (b)     prepare an individual supportplan for theaccused.

    (2)     The Court must fix a return date forconsideration by the Court of the proposed individual support plan.

    (3)     On the return date, the Court may—

        (a)     subject to subsection (5),approve the individual support plan, with or without amendments;

        (b)     fix bail conditions or anyundertakings or other conditions the Court considers appropriate;

        (c)     make any otherorder the Courtthinks fit.

    (4)     The Court may adjourn aproceeding under thissection for a period not exceeding 12 months to enable theaccused to beassessed and participate in and complete his or her individual support plan.

    (5)     The Court must take a formal plea from theaccused before approving an individual support plan under subsection (3)(a).
