MAGISTRATES' COURT ACT 1989 - SECT 4O

Jurisdiction of Neighbourhood Justice Division

    (1)     In this section—

"close connection" means connection involving regular congregation for thepurpose of social or community support;

"municipal district" means amunicipal district specified undersection 4N(b).

    (2)     The Neighbourhood Justice Division has thejurisdiction referred to in this section if—

        (a)     in the case of a criminalproceeding, theaccused

              (i)     resides inthemunicipal district; or

              (ii)     is ahomeless person who is alleged to have committed the offence in themunicipal district; or

              (iii)     is ahomeless person who is alleged to have committed the offence outside themunicipal district but who is living in themunicipal district inaccommodation of the kind referred to in paragraph (a) of the definition ofhomeless personinsection 3(1); or

             (iv)     is anAborigine with aclose connection to themunicipal district and is alleged to have committed the offence in thatdistrict;

        (ab)     in the case of aproceedingunder thePersonal Safety Intervention Orders Act 2010

              (i)     at leastone of the parties resides in themunicipal district; or

              (ii)     at leastone of the parties is—

    (A)     ahomeless person; or

    (B)     anAborigine with aclose connection to themunicipaldistrict

and the Court considers that it is appropriate to deal with the matter in theNeighbourhood Justice Division; or

              (iii)     the wholeor a material part of the alleged stalking or prohibited behaviour occurred inthemunicipal district;

        (b)     in the case of a civilproceeding or aproceeding under theFamily Violence Protection Act 2008ortheNational Domestic Violence Order Scheme Act 2016

              (i)     at leastone of the parties resides in themunicipal district; or

              (ii)     at leastone of the parties is—

    (A)     ahomeless person; or

    (B)     anAborigine with aclose connection to themunicipaldistrict

and the Court considers that it is appropriate to deal with the matter in theNeighbourhood Justice Division; or

              (iii)     the wholeor a material part of the cause of action or claim arose in themunicipal district; or

              (iv)     the wholeor a material part of the allegations of family violence occurred in themunicipal district.

    (3)     Subject to subsection (4), the NeighbourhoodJustice Division has—

        (a)     the jurisdiction of the Courtgiven bysection 25; and

        (b)     the jurisdiction given to theCourt with respect to a criminalproceeding by or under any other Act; and

        (c)     jurisdiction to deal with abreach of asentence imposed by it (including any offence constituted by sucha breach) or variation of such asentence; and

        (d)     the civil jurisdiction of theCourt in respect of a cause of action or claim, or a class of cause of actionor claim, or aproceeding, or a class ofproceeding, specified inthe rules;and

        (da)     the jurisdiction of the Courtgiven by thePersonal Safety Intervention Orders Act 2010; and

        (e)     the jurisdiction of the Courtgiven by theFamily Violence Protection Act 2008; and

        (ea)     the jurisdiction of the Courtgiven by Division 4 of Part 7 of theNational Domestic Violence Order SchemeAct 2016; and

        (f)     the jurisdiction of the Courtgiven by theVexatious Proceedings Act 2014in relation to interventionorderlegislation within the meaning of that Act.

    (4)     The Neighbourhood Justice Division does nothave jurisdiction to deal with—

        (a)     a committalproceeding into anindictable offence; or

        (b)     aproceeding for asexual offence as defined in section 6B(1) of theSentencing Act 1991.
