(1) If alegal practitioner for aparty to aproceeding, whether personally or through a servant or agent, has caused coststo be incurred improperly or without reasonable cause or to be wasted by unduedelay or negligence or by any other misconduct or default, the Court may makeanorder that—
(a) all or any of the costs betweenthelegal practitioner and the client be disallowed or that thelegal practitioner repay to the client the whole or part of any money paid onaccount of costs; or
(b) thelegal practitioner pay tothe client all or any of the costs which the client has beenordered to pay toanyparty; or
(c) thelegal practitioner pay allor any of the costs payable by anyparty other than the client.
(2) Without limiting subsection (1), alegal practitioner is in default for the purposes of that subsection if anyproceeding cannot conveniently be heard or proceed, or fails or is adjournedwithout any useful progress being made, because thelegal practitioner failedto—
(a) attend in person or by a properrepresentative; or
(b) file any document which ought tohave been filed; or
(c) lodge or deliver any documentfor the use of the Court which ought to have been lodged or delivered; or
(d) be prepared with any properevidence or account; or
(e) otherwise proceed.
(3) The Court must not make anorder undersubsection (1) without giving thelegal practitioner a reasonable opportunityto be heard.
(4) The Court mayorder that notice of anyproceeding ororder against alegal practitioner under this section be givento the client in such manner as the Court directs.
