TheTwentieth Amendment of the Constitution Act 2001 is anamendment to theConstitution of Ireland which provided constitutional recognition of local government and required that local government elections occur at least once in every five years. It was approved byreferendum on 11 June 1999 and signed into law on 23 June of the same year. The referendum was held the same day as thelocal andEuropean Parliament elections.
The structure oflocal government in Ireland dates back to theLocal Government (Ireland) Act 1898, subject to amendments since then. There was no reference to local government in the Constitution as adopted in 1937. Local elections were held at irregular intervals: the local elections held previous to the adoption of the Amendment were in 1991, 1985 and 1979. Constitutional recognition of local government was proposed by the All-Party Committee on the Constitution, including a requirement to hold regular election.

LOCAL GOVERNMENTArticle 28A
- The State recognises the role of local government in providing a forum for the democratic representation of local communities, in exercising and performing at local level powers and functions conferred by law and in promoting by its initiatives the interests of such communities.
- There shall be such directly elected local authorities as may be determined by law and their powers and functions shall, subject to the provisions of this Constitution, be so determined and shall be exercised and performed in accordance with law.
- Elections for members of such local authorities shall be held in accordance with law not later than the end of the fifth year after the year in which they were last held.
- Every citizen who has the right to vote at an election for members ofDáil Éireann and such other persons as may be determined by law shall have the right to vote at an election for members of such of the local authorities referred to in section 2 of this Article as shall be determined by law.
- Casual vacancies in the membership of local authorities referred to in section 2 of this Article shall be filled in accordance with law.
The Amendment was sponsored by theMinister for the Environment and Local Government and was proposed in the Dáil on 11 May 1999 byMinister of StateDan Wallace on behalf of theFianna Fáil–Progressive Democratscoalition government led byTaoiseachBertie Ahern.[1] It was passed final stages in the Dáil on 12 May where it was opposed byopposition partiesFine Gael, theLabour Party, theGreen Party, theSocialist Party andIndependentTony Gregory. Their opposition was to elements of the drafting rather than the principle of constitutional recognition of local government.[2] It passed final stages in the Seanad on the same day, and proceeded to a referendum on 11 June 1999.[3]
AReferendum Commission was established byMinister for the Environment and Local GovernmentNoel Dempsey.[4] At the time, its role included setting out the arguments for and against the proposal.[5]
