Kentucky Circuit Courts

TheKentucky Circuit Courts are thestate courts ofgeneral jurisdiction in theU.S. state ofKentucky.

The Circuit Courts aretrial courts withoriginal jurisdiction in cases involvingcapital offenses and otherfelonies;land disputes; contestedprobates ofwills; andcivillawsuits in disputes with anamount in controversy over $5,000. Circuit courts also have the power to issueinjunctions,writs ofprohibition, writs ofmandamus, andappeals from the decisions ofadministrative agencies.

Circuit Courts also hearappeals from theDistrict Courts, which in Kentucky are courts oflimited jurisdiction that hearmisdemeanor criminal cases, traffic violations, violations of county and municipal ordinances andsmall claims.

The family court division of Circuit Court has original jurisdiction in cases involvingdissolution of marriage (divorce),child custody,visitation, maintenance and support (alimony andchild support),equitable distribution of property in dissolution cases;adoption, and termination of parental rights. The family court division hasconcurrent jurisdiction with the District Court over proceedings involvingdomestic violence and abuse, the Uniform Parentage Act andUniform Interstate Family Support Act, dependency,child abuse and neglect, andjuvenilestatus offenses.

In 2019, theKentucky Supreme Court created aBusiness Court Docket Pilot project in the Jefferson County Circuit Court, effective January 1, 2020.[1]

Circuitjudges serve in eight-year terms. There are 57 circuits, which may have one or more judges, depending on the population anddocket size. Circuits may include one or morecounties; some have up to four. TheJefferson County Circuit Court is the largest single unifiedtrial court inKentucky.[2][3]

Appeals from decisions of the Circuit Courts are made to theKentucky Court of Appeals, the state intermediate appellate court, which may be further appealed to theKentucky Supreme Court. (Criminal cases in which adefendant has been sentenced to death,life imprisonment, or imprisonment of 20 years or more are taken directly to theKentucky Supreme Court.)
