이 논문은 한국노동 현장에 있는 이주노동자와 그들과 함께 해온 실무자들을대상으로 심층 면담한 내용을 분석하여 이주노동자들의 실태와 문제점을 파악하고해결방안을 모색한 글이다.이 글에서는 먼저 이주노동자들에 대한 저임금, 장시간 노동, 열악한 조건의노동현실, 거기에 따르는 건강문제, 노동자들의 삶을 위협하는 임금체불, 작업현장에서 철저하게 무시당하는 인권과 언어폭력 등을 살펴보았다. 이주 여성노동자의 경제적 조건은 남성노동자들에 비해 더욱 열악한 상황이다. 더욱이 인권의 사각지대에 놓여 있는, 한국 사회에서 법적으로 전혀 보호받지 못하는 미등록 노동자들의 실태 분석을 통해서 인간에 대한 존중 없이 노동력만을 사용하고, 학대를방지하기 위한 어떠한 실질적 조치도 부여하지 않은 채 사람을 이용하도록 허용하는 정책은 그 자체가 인권 침해임을 알게 된다.그 다음, 미등록 노동자들 사이에서 태어나 불법으로 체류하는 어린아이들이처한 심각한 문제를 드러냄으로써, 가치가 배제된 한국의 다문화주의의 허구성을지적하였고 다양한 문화와 혈통을 가진 여러 문화권 사람들이 서로를 동등하게 대우하고 공존하며 각자의 고유한 특성을 서로 수용하는 방법을 배우는 상호문화적이해를 살펴보았다.끝으로, 외국인 노동자에 대한 부당한 제도적 제약이 철폐되고 내국인노동자와외국인 노동자가 공존할 수 있는 최적의 상태, 누구나 자신이 일한 만큼 보상받고, 함께 어우러져 사는 사회를 지향하는 방안으로 소통과 연대를 통해 수평적공존을 모색하는 해결방식, 자율과 자치를 기본으로 하는 삶의 자율성 회복,편견과 차별 없이 더불어 살고자 하는 삶의 방식을 제안했다.

This paper analyzes in-depth interviews of immigrant workers in Korea and Korean staffs working with them. And, it also tries to figure out their current situations, problems the immigrant workers experience and their solutions too.In this paper, the critical issues that immigrant workers are confronting are dealt with: low income, long working hours, terrible working conditions and health problems, delayed payment of wage that threatens human life itself, abuse of human rights in a working place, and abusive language, etc.Especially, female immigrant workers’ economic conditions are much worse than those of male workers. The analysis of the situations of non-registered laborers who don’t secure any legal protections in Korea makes us realize the fact that the current labor policy taking advantages of laborers without providing any measures to prevent any abusive situations is in itself the human rights abuse.The paper also points out that the current situations of the children of non-registered immigrant workers reveal how unrealistic the Korean-style multiculturalism is. It suggests the “interculturalism” as a more proper concept in which people coming from different cultural backgrounds respect with one another and acquire mutual understanding.Finally, it suggests the removal of unfair labor constraints to achieve the best conditions under which local and immigrant workers can coexist by getting a reward as much as they work, an equal existence through communication and solidarity, and recovery of autonomous life based on self-governing for a life without prejudice or discrimination.
