【重要】6ヶ月以上ご利用のないお客さまへの再利用のお願いについて
この件が予告通り施行されたやつね。
自分のアカウントはなぜか停止されていなかった（おそらくお遊びで作られた共有口座に入金があったからだと思うが）（まあ67ポイントしか持ってないので止まっても別に良かった）が、いくつか気になることがあったので調べていた。資金決済に関する法律は結構好きなのだ。
どちらも資金決済法に基づいて提供されるサービスだけど、Kyashバリューは前払式支払手段で、Kyashマネーは資金移動業に係るサービスで性格が異なる。後者は銀行が担っていた業を一部解禁するものであり、前者よりかなり厳格なもの。わかりやすいところで言えば利用者保護のための供託金の額は、前者は未使用残高の50%以上、後者は100%以上となるなど保護の度合いが異なる。今回の件では、アカウントが削除されるのでどちらも消滅したこととなった。本記事ではKyashマネーについて記載する。
資金決済関係の問題でまず見たいのは「資金決済法に基づく表示」。
Kyashバリューの資金決済法に基づく表示 (www.kyash.co/legal/description-subject-to-psa/psa-prepayment ) には以下のように書かれている。

続いて、Kyashマネーの資金決済法に基づく表示 (www.kyash.co/legal/description-subject-to-psa/psa-transfer ) を見てみる。
9.Kyashマネーアカウントの削除等の理由により、Kyashマネーアカウントが終了した場合には、Kyashマネーアカウント、Kyashマネーアカウント内のKyashマネー、その他これらに関しての利用者の権利は、全て、理由を問わず消滅するものとします。
と書いてある。9条は有効期限関係なくない？と思われるかもしれないが、Kyashマネーアカウント利⽤規約の第24条 （マネーアカウントの閉鎖）の(8)には以下のように書かれていて、
実はめちゃくちゃ関係ある。
Kyashバリューについては、※注釈ではあるものの利用実績基準の有効期限も書かれているので、今回の消滅は別にいいかなと思うが、後者については何のための「資金決済法に基づく表示」なのかなと感じる。利用規約と組み合わせないと読み解くことができないし、そういう状況でありながら有効期限を無期限と書くのはミスリーディングだと思う。
そもそも「資金決済法に基づく表示」を表示する意義に立ち戻って考えてみると、”前払式支払手段”に関する規定ではあるが以下の内閣府令に書いてある。
法第十三条第一項各号に掲げる事項は、前払式支払手段を一般に購入し、又は使用する者が読みやすく、理解しやすいような用語により、正確に情報を提供しなければならない。
これは消費者保護の観点、つまり「いちいちサービスを利用するのに利用規約など関連規定を全部読んで理解するのは大変すぎるし、消費者のためにわかりやすい情報を提供しなさい」と解釈している。私もそうあるべきだと思う。ちなみに前払支払手段では、残高に有効期限がある場合はそれも掲載してねという規定がある（なお、これは内閣府令ではなくて資金決済に関する法律13条の3にかかれている）。
下記の資金移動業者に関する内閣府令においても情報提供の規定はあるが、「読みやすく、理解しやすい」みたいな表現はなくなっている。確かに、資金移動業に関する基づく表示を読んでみると、いきなり銀行等が行う為替取引でない宣言など、利用者保護からはちょっと遠いかもなあという条文が並んでいると感じる。とはいえ、本質的な目的としては消費者保護だろうと思う。
資金移動業者に関する内閣府令第29条 (laws.e-gov.go.jp/law/422M60000002004#Mp-Ch_2-At_29 )
なお、前払支払手段と違って資金移動の方には有効期限を書けという規定はないので、書いてないことがまずいわけではない。もちろん各自任意で書いてもいい。
楽天キャッシュには前払式支払手段である「基本型」と資金移動業に係るサービスである「プレミアム型」がある。Kyashマネーアカウントに類似するのは「プレミアム」の方。プレミアムの「資金決済法に基づく表示」には有効期限の記載はない。一方、利用規約には以下のような規定がある。
第９条（失効）
本サービスの利用により最後に楽天キャッシュ【プレミアム型】又は楽天キャッシュ【基本型】の残高に変動があった日から１０年を経過した場合、当該会員の保有する楽天キャッシュ【プレミアム型】は当然に失効するものとし、現金による払戻し等は行われません。
これをどう評価するかという話になるが、民法においても消滅時効は「権利を行使できる時から10年」だから、まあそこまで目くじら立てなくてもいいと個人的には思った。
PayPayにも色々ポイントがあって（PayPayマネー,PayPayマネーライト,PayPayポイント）わかりにくいけど、PayPayマネーが比較対象になる。
を見ると、
(3)閉鎖されたPayPayマネーアカウントおよび、ビジネスアカウントにPayPayマネーの残高が残っていた場合には、当該残高は失効するものとします。当社は、失効したPayPayマネーの残高に相当する金額の返金を行わないものとします。
あっ、これKyashで見たやつだ！となるので、利用規約を見に行ってみる。
「第6条 解除」が該当する条だが、そこには「(4)本規約その他の利用者に適用される規約に違反した場合」があるので、全体をざっと眺めつつ主要な禁止事項である「第7条 PayPay残高アカウントの利用にあたっての禁止事項」を見るが、最終利用の規定はない。なお「(12)その他当社が不適切と判断した行為」とバスケット条項はあるものの、ここに「ポイントの動きが6ヶ月ないこと」みたいな規定が含まれると強弁されたら流石に起こると思うので、最終利用からの残高没収はなさそうと判断した。
少しだけ眺めてみても、サービス内で利用するポイントとかではなく、広く開かれた決済に利用するポイントが最終利用から6ヶ月で消えるのは流石に利用するサービスとして選択できないなあというユーザー目線と、強く保護されるべき資金移動業に係る残高が6ヶ月未使用で消滅できちゃうのは法律としてそれでいいのか、という気持ちにはなった。
資金移動業に係るサービスの残高の有効期限は特に法的な縛りはないので、じゃあ「6ヶ⽉以上にわたりマネーアカウントの利⽤実績がない場合」に停止対象となるという規約がいつから書かれていたのかということが気になったので調べてみた。そしたらちょっと面白い事がわかった。
2022年1月8日のWebArchiveでは、「第28条（利用者に対する本サービス等の利用停止、その他措置等）」には予告なくアカウントの削除などができるとしているが、但し書きとして、「但し、第8号に該当する場合には、本サービス等の利用の停止、中止のみ行います。」と書いてある。そしてその第8号は
という今回の根拠条項が出てくる。つまりこの時点では、最終利用基準の没収はやり過ぎと判断されていたと見える。
では、この規定がいつ変わったのかと調べてみると、2022年2月1日のお知らせ
に公開されている「改定後利用規約：Kyashマネーアカウント利用規約（旧「Kyash送金サービス利用規約」）」から見れる規定ではもう書き換わっていた（閉鎖に関する規定は28条から24条に移動している）。そしてこの日のお知らせの「主な改定内容」にはこの変更は含まれていないので、1月8日から2月1日までの間に、改定されたと考えるのが良いと思うが、特にお知らせは出ていなさそうだった…。
となると、主な改定内容ではないと判断されたということかな。流石に結構な不利益変更になるし周知したほうがいいんじゃないかなあと思うが、ここの法的な是非は私にはわからない。
別のことしようと思ってたのにこれに書くのにめっちゃ時間使っちゃった！最悪！！
